I'm curious... Can a hosting "company" operate without actually being incorporated?

What are the drawbacks to doing so?

if ur sued for whatever reason, all of YOUR money/properites/etc. can be taken.

the whole point of an INC or LLC is to seperate personal from business.

without it, they are one in the same.

so to answer ur question, sure u dont need to be incorporated. but it would be very stupid to do so.

Being incorporated will not necessarily protect you or your personal assets.

Hosting (and web design/development) are considered professional services like a lawyer, accountant, engineer, doctor etc. As such the services are performed by an individual, not the corp.

So if an engineer makes a bad design that gets someone hurt, he/she can be sued even if their business ins a corp or LLC.

There are other business reseasons for being a corp or LLC (like seperation of lines of credit from person to business) but protection unfortunately isn't one of them. :(
