I just caught the tail end of a bit of news mentioned on MSNBC...

It appears that a kid has sued his friend.

Apparently the 9 year old hit the 10 year old with a bat, broke a bone and knocked out one of the 10 year olds teeth... a Judge somewhere (NY or NJ i think) Said that the case needs to go before a jury to see if their was criminal intent... if there was intent then the kid can sue the other one.....

I think while this case is rediclous.... it may open doors to be able to sue all of those "rip off" kids on the web that live in the us... it'll be intresting to see how this one turns out..

Kids that age can engage in law suits? I guess I'm lucky I grew up in a different era.

I me and Rotifer like the crime storys, we like to get all sticky in them;).
But yep seems an interesting story.
The way i think is well take this for example, if your a kid going round acting all hard and someone comes up and hits you with a bat then you get what you acted like you went looking for..
I remember a few years ago my brothers freind got smashed up by some people and the sad side of it is that he came to my family for help because his mum couldn't care less but saying that the boy which would have been like 16 at the time was smoking all the hash and acting a bit hard not that i'm saying anyone who acts hard should get kicked in because acting hard is often a way to stop you getting done over..
isn't that sad? his mum didn't care about him so he came to us when he got done in.Oh well guys..He was a nice lad as well, a really nice lad.

These law suits are getting funnier and funnier as time goes on. Quite ridiculous things that most people would just brush themselves on and walk away from.

I read in the Daily Telegraph (major newspaper here in Sydney, Australia) last week that a group of people were launching a class action against McDonalds because it "made them too fat".

It gave me the giggles afterwards :D

You usually don't walk away from getting hit with a baseball bat :D

Whoops. I did have a longer message but took some of it out, that part went with the longer message :)

Basically talking about some cases where people have tripped on the sidewalk, etc. - grazed their knees and sued the local council.

Stupid things like that being met with huge payouts (sometimes in the millions) have resulted in the public liability insurance crisis we're currently having here in Australia.

Me - if I tripped over I would brush myself off and hope nobody seen me fall :D, but if somebody hit me with a baseball bat it would be a different story - I would have them charged with assault and then possibly persue things in a civil court.

Think about it though - what are you going to get out of a 9 year old (unless you go after the parents). A nine year old won't be able to pay money and they generally don't have assets such as a house, etc. I didn't even think you could sue a minor?

I think this is not for the courts, but damn, I would have taken the bat off the guy even before he spoke one word.

Guy walks up to me holding a bad, I don't even wait I just take the bat and smack him on the head with it....Oh!! you wanted to play ball!?! errrr heh... :D

I remember this story about this granny who bought a coffee and mcdonals and she spilled it on herself and she sued mcdonals for the coffee being hot. If i remeber correctly she actually won the case and got around $250 grand.

What a world we live in

Didn't she also say that her sex life got worse after she spilled that hot coffee?

Trust me, we have a lot of retards like this in United States who try to sue McDonals and other major (not small fast food places that don't have millions) fast food restaurants.

At the moment there is some 30+ year old guy suing major fast food restaurants because he never knew that it's unhealthy to eat it.

Actually Shaun brings up a good point, you use to could not be able to sue a minor.... but this judge has said if a jury says its ok its ok... this would be a landmark case and open up lawsuits to those under age... i.e. those teenagers that we all know about that go around ripping people off.... using that case as a basis you could sue the teen in civil court and it'd stick... no more "he's under age" crap :), I kinda like it myself...

It's not as bad as it sounds. The coffee was *HOT*. About 20 degrees hotter than coffee normally is, and hot enough that McDonalds had been warned several times that it was dangerous.

If you spill normal hot coffee on yourself, you'll be in pain. If you spill McDonalds Super-Extra-HOT coffee on yourself (prior to the lawsuit, which resulted in the temperature being changed), you'll suffer actual injury.

Yes thats true, I order tea and I can't drink it for about 20 minutes.

On another note... we have kids in Sweden who pick on other kids, steal their cellphones (they're really cheap here and comes with pre-paid cards), steal their new mopeds (the type that looks like a small italian MC), bullies... If they could be brought to better judgment than "we'll let the socialworker look at it" things would be better here.

On that McDonalds hot coffee case the woman got 2 million not 250k. You could dunk me in a pool of hot coffee for 2 million :D .. As far as getting sued it is sickening it is getting to the point that you have to watch everything you do because everyone is so sue happy and if needed you cannot defend yourself. My freind was with his girlfriend one day and some kid walked by grabbed her ass and said something pretty x rated to her, they ended up arguing back and forth for a min and he pulled out his little willy and showed it to them so my freind went over grabbed him by his stuff with his left hand and clocked him with his right hand and broke his jaw.. after being arrested and doing the whole court thing for almost 2 years my freind ended up having to pay 5k to that di**head.. i mean seriously what is this world coming too.. anyway thats my rant.

I know - it's getting quite ridiculous. I know people who have had their house burgled, the burglar cutting their hand smashing a window and then suing them for negligence.

My Grandmother has to have public liability insurance on her property in case some moron tries to steal animals and slices himself up on her fences and proceeds to sue.

There was a case here recently where a person sued the Dept. School Education because of a fight he got into when he was a kid. He got several million because of it (I forget the exact amount). The claim was that the fight damaged him psychologically (or something) completely destroying his dreams of becoming a pilot... the thing is he was colour blind anyway which means he wouldn't be able to become a pilot regardless if the fight happened or not.

Some of the things I've seen people getting huge payouts over I've thought to myself "Hey.. that happened to me once" - but I'm not going to sue over something so ridiculous.
