Hi!
Here's a slightly long thread.. I'm sorry about it but I'm confused and need your help...
About 8 months back we had a customer contact us, Timothy Dick from xyz. We gave support for him. Somehow the payments delayed and the guy vanished. I went on pestering him about the payment and finally left it.

After about a month I get a contact from another Timothy Dick with a hosting company called abc. He apparantly purchased xyz.. Look into the registered address of both xyz and abc...

So naturally I told him make the pending payment and we'd start service. We have nothing against the person as such. But the person got wild and went on with another reputed company. Anyway, we had forgotten the matter.

Yesterday, this person suddenly signs up on bobcares. So I reminded him about the previous pending and was waiting for the reply... Please note that I had nothing against the customer and was ready to start if he pays his dues which I think is justified.
Anyway, here's what our friend does... I'm pasting the mail below..

I'd like to have your suggestions as to what I should do....

To Whom It May Concern:

I placed an order for $20.00 (transaction ID 23016326) and was
informed by this merchant later that I was ineligible for service because of
a problem over a year ago with a company that we acquired.

When I awoke this morning, I noticed that there was another
transaction 23027143 for $24.00 to the same merchant. I only
authorized one transaction.

If both transactions are not fully refunded within 24 hours of this
e-mail, I will initiate chargebacks. This unethical behavior on
behalf of the merchant is simply preposterous and unacceptable in the
business world.

In addition to those chargebacks, I will also be in touch with my
attorney because this type of behavior is something I will not
tolerate.

Like I previously stated, you have 24 hours to refund all funds.

But, I will tell you what I would do.

http://web.archive.org/web/20010303030444/pcpshosting.com/contact.shtml shows a page from March 2001 that has the same address as they have today. Except that 1381 was a post office box then. . . . strange. :eek:

Along with the whois information; it's obvious it's the same person.

Amar,

I don't think you acted unprofessional at all and I wouldn't lose any sleep over not getting this customer. He would have just turned out to be a pain any way.

I would like to step in here. I am the Timothy in question in this thread.

Months ago as Amar said, they were helping us with support, however we cancelled before our trial period was over because our customers needed more than the responses they were providing. I will not go into details of that as it reallydoesn't belong in this thread since it’s not about their service. There was a company acquisition involved and there are two Timothy's in this company so that confused things. As for he AIM conversation, I have logs of what was really said for those interested.

Recently, we did change our name to Avity because PCPS stood for PC Problem Solvers and we had changed from primarily being a computer repair company to a company focusing on internet access mainly.

We had one of our resellers ask us if we could provide support assistance and we mentioned we would outsource to another company because the chance for our technicians to mix their customers with ours was there. Almost the only option available was BobCares for this and we decided to do that.

Now, BobCares informs us that because we cancelled long ago, we're not eligible to have any service. When I woke up this morning, I had a second charge on my credit card and a receipt from WorldPay. That is why I asked for these to be cancelled.

There is absolutely no way we would signup for a $24 plan for our own customers. We have several hundred virtual accounts under management on multiple servers and I can name at least 5 well-established people on this forum that can attest to that because they have helped with things as needed. So there would be absolutely no reason for us to signup for our own company and proves it was for a reseller like I stated.

I am sorry if it looks like I am just trying to defend my reputation, but that is basically what I am doing. BobCares is making us look like the bad guy when in fact we did nothing wrong. They did refund our payments and so they did nothing wrong either. I just don't see how this belongs in a public forums.

Now it is interesting that they post things like this. How do their customers know they will not post something about them. That breaks all confidentiality of using their company.

I'm not up with all the details of the prior owners, but I can attest to the character of Timothy Dick -- the current owner of Avity. I worked for him for about 3 months, and he never lied or cheated me out of information or payment. He was always straightforward and prompt.

The conversation logs you posted don't sound like him at all, and I'm interested in the verification of them.

I found that part kind of funny. I love how people just throw around "I am contacting my attorney." Especially for $24.

Two things. (1) Posting publically about something like this is always a good thing...but (2) posting the name of the client is not, especially if you have a confidentiality clause on your site. That's the only thing I wouldn't have done is not listed his name.

Question, is there a free trial period that you offer and if so how long is it?

I was not interested in taking on to a fight or anything.
All I felt offended was that Timothy wrote like this to bobcares as well as worldpay our credit card processor.... To top it all he says we were unethical and did not keep privacy. We have had so many clients who do not agree to what we say on public forums. Even potential customers may disagree on many issues but never is our integrity or honesty questioned. Hence, everything is kept anonymous.

And yes if he wants to take us to court then we sure have to defend us....

Also for the record sake. When a sign up takes place on bobcares there is a setup fee of $20 and then the next day there is a charge of the package purchased. In this case $24... This is the reason for the 2 two payments. Anybody familiar with future pay system on worldpay would be knowing about this... We do not store the credit card numbers of our customers and have no interest in charging them anything extra...

Mike, I too fully agree on the confidentiality part and apologize if it did any harm to anybody.. I had no intentions about it and will not ever do it again...

Cool. Actually even I was reminded of the same ad. But I always thought it was an Indian ad.....small world...
