I recently heard that Facebook tried to sue some website for copyright infringement even though the website didn't even look like facebook and all that.
So, this rises a question: where do you draw the line? Or more correctly, where does the judge draw the line between a site that simply looks similar and a real attempt to copy the general look and feel of a website?
My current websites aren't big so it is not an issue yet but I was wondering if it might become a problem if I decide to build a website with a blue-white theme that KIND OF looks like another website?

Just because it "kind of " looks like it doesn't mean anything. I've had some experience with this and you draw the line where you can clearly see that one site was ripped or used as a reference.

You mentioned " My current websites aren't big so it is not an issue yet". I advise you to be even more careful, the last 2 sites that I had ripped were fairly new, one was within 1 week of it's release.

To answer your question: My site (http://skshost.com) & the Ripped site (http://canaduh.ca). IMO they ripped it because they are cheap, lazy, and have no morals, but at this point there's nothing I can do since it's not worth the retaining/court fees and their data center/registrar couldn't care less. "It's not their problem".

It really hurts, and I hope you'll never have to go through it, but unfortunately there's not much you can do. The big guys can take it, but it's little guys like me that struggle when their work is stolen and cannot sell it to others as unique.

These thieves are ultimately draining my bank account. Many companies have to increase prices for everyone to make up for what's been stolen, which I hate to do, but must to survive.

Usually when someone rips a site/template, they are either doing it in a form of revenge, a form of imitation, or a form of flattery. For example: in the form of flattery, when I am creating templates, I often create them by my memories of other templates. Like, say if I wanted to use rounded corners, I would look at examples of other rounded corners, and narrow down my options.

Colors and Markup cannot be trademarked or copyrighted. Thats like Google copyrighting a all white page with a logo and input box.

Its a shame to have something like this happen. If it did infact happen.

You will certainly want to look more into it before you start accusing anyone of anything.
