Adam contacted me after reading my post on WHT for my designer search. I liked his portfolo. I sent him specifications and we discussed what I needed. Then I PayPal'd Adam $100 advance on July 23 to design a homepage. Adam said it will take 3-5 days but that he could do it in two if I really needed. I let him know the quicker the better as we were on a tough deadline.

On July 25, I emailed Adam at 8am EST asking how things were coming. Then I sent him another email at 4pm later in the day. He finally replied in the evening saying latest he will have it by 11pm next day.

I misread Adam's 11pm for 11am and to my fault, sent him a couple of emails the next day letting him know I was not happy. It was a misunderstanding and I apologized.

Same day, 11pm came by and passed. I did not recieve the design at 11pm as promised by Adam. I sent him another email in morning. Later in evening, he wrote back about an emergency which caused the delay in him delivering something the day before. He sent the design in the email.

By this time, I had picked another designer. Additionally, after two day long delays Adam had sent a design that was very half baked to what we discussed and what the specifications stated. It seemed like a WHT template than a custom design.

I emailed Adam after seeing the design stating that I had picked another designer earlier in the day and that this design isn't on par with our discussions. I asked him to refund the $100 I paid him since I have only lost time and gained nothing from his half-baked design.

It has been five days since that email and Adam has not responded to my email nor my MSN messages though I can see him logged in every now and then.

If you chose another designer you should of told him before he sent the design. I wouldn't give a refund if I had already sent the design either.

Was a contract in place? By the looks of the text you typed, probably not. For the life of me, I can not understand why anyone would do any extensive work on website design, implementation or development of scripts, etc without a contract in place, a deposit upfront and the rest upon completion.

Better luck next time!!

Seriously, it would be better off if he did not send anything. I'm sure Adam knows that. He is not a fool - he knows what good design is and it was clear what he made was a rush job done to just show me something. If Adam clearly believed in that design, he would have at least replied to my email.

Serverpedia - we did not have a paper we signed. But I have every line of chat discussion we have done.

I wouldn't refund it either.

If you truly believed you weren't on the wrong, you would at least reply to the client's mail, no? Not avoid the client like Adam is doing.

I wonder what his excuse is for not replying to my emails that I've sent since I recieved the half-baked design.

Adam has shamelessly gone ahead and escalated the dispute in PayPal, ignoring my emails.

His PayPal response is full of lies including "There was never a contract signed, I offered but the buyer insisted it was not worth it." Adam, mind showing where in our conversations that was offered to me?

"The buyer was presented a design as promised."
Really? As promised? More like after two delays. And not adhering to most of the requirements we discussed.

"Digital theft should not be tolerated on paypal!"
Indeed, I will steal a half-baked cookie cutter design that is NO WHERE close to the requirements we agreed to and NO WHERE close to the design we are going forward with.

Adam Ellifritt is a con full of lame excuses. His design work is not any better either.

I did offer a contract, I also have the conversation saved. I did respond to his email, I forwarded the original message. This guy is seriously milking this for all its worth. He wanted a design done in 2 days, I told him that this was too short of a deadline but I would do my best. However awhile before the deadline we had a very close family friend die at the age of 17 for sustaining serious damages to her head from her car accident. I told zaid that my family and friends come first and I would do my best to get him the design on time.

I also told him I had several other variations that I would show in due time. Ironically, he knocks my design skill when I sent him several of my portfolio links and in his document, he referenced one of my works to all the other freelancers he sent the spec to, as to inform what he wanted. Not to mention, it was number one on his favorite designs.

I hope a WHT admin will jump in here and clear this up.

I can also post the original design too if everyone is interested. If needed I will post all conversations, design and original specifications as well.

You just forwarded me an email that you *supposedly* sent to me. The only problem? I never recieved it. My fault right? Except I emailed you three different times. And tried to contact you on MSN. So it should be obvious to you I have not recieved that email and the right thing would be to make sure you got back to me. (And btw, why is that email's TO not to my email address?)

I appreciate you sending the refund. I will request this thread be removed as soon as the payment clears.

Adam got in touch with me and issued a full refund.

I hope others who are in a similar situation can get their money back.
