I guess I must do good designs, because people keep stealing them.
Take a look at: http://canaduh.ca/index.php. It's a complete rip of my formal Sks Host site. They've even copied much of the content.

Even better, view the source of this page: http://www.my.canaduh.ca, their WHMCS install, You'll see
<!-- Designed & Developed by TJ Phippen, tj[at]designsks.com (tj@designsks.com) -->, which is me.

Maybe I should just charge them for it, lol!

EDIT: just in case they try to cover their tracks, I'm sure google will have it cached for a while.

That really stinks, these stupid rippers. We should form an "Anti-Site ripper union" consisting of lots of us irritated site rip victims and lawyers (except not).

I'm uploaded a backup w/o WHMCS of my design here: http://softespy.com/skshost/index.php

I guess I should be flattered, but I'm not.

This is the second time this week I've have to deal with people stealing my work. What can I do to protect myself?

I thought those thieves are in hosting business.

I think it would cause them some mojor inconvenience if you expose them in the hosting forum.

I talked to the owner and he said he couldn't find where it said " <!-- Designed & Developed by TJ Phippen, tj[at]designsks.com (tj@designsks.com) -->", mysteriously it vanished moments after I spoke with him. Can previous viewers of this post verify/claim that if was there earlier?

He said he paid a designer $1100 for the site, and told me not to pursue legal action because.. "I'm in Mexico, and it wouldn't matter." I am now awaiting response from "his designer".

Fun Stuff! :)

Yeah, it sucks. He lies and now I really I have to sue him. Good thing I'm smart and know how to protect the evidence. :)

99.999% of the hosting customers in this world have never even heard of WHT.

I would ask myself how this keeps happening and what you could do to stop it from happening in future....do you display your creations freely..?? is this a sold template that has gone through hands.??.
Do you make agreements on copyrights with your customers.?

Also tell the owner of the site you have documented evidence to prove that you are the creator and owner of that material and it is copyrighted to you. If he has paid that much money to a designer for a ripped website that is his problem not yours, his job to chase up his designer...Issue him a cease and desist letter and request the site be taken down immediately to avoid further action.

He's giving me the run around, not providing me with proof that he's not the thief here, and now stating that he's not the owner and just an employee. All the needed action will be taken tomorrow if it's not down. I was nice and gave the cease and desist 48 hours(from yesterday).

I'm not at all speaking down on the forum or anything, I mean this site is HUGE. But it's important to keep the scope of the whole community. There are so many billion (literally) web pages out there, and so many thousands of hosts (if not hundreds of thousands).

Customers don't have any reason to search this site out in most cases. Designers, programmers hosts and other providers do.,

What's really interesting is that you yourself were guilty of doing the exact same thing earlier this month: http://www.webhostingtalk.com/showthread.php?t=611799

Funny how things tend to come full circle, eh?

Plenty of sites are ripped from others. We have even had clients wanting websites made to look a lot like other sites and we have had to talk them round.

It's ironic that they claim to be web designers and yet they clearly ripped your design.

Best of luck with this, mate.

It's been over 30 days since I first contacted Canaduh.ca. The owner claims he's not the owner and no one takes responsibility. Enom and their DC aren't replying and I'm waiting on Google's response to a DMCA submission.

Anyone can see http://canaduh.ca is a blatant rip of http://skshost.com
I just want the site down. At this point I think they should be paying me for it, but unlikely, so a $5k retaining fee it hardly worth it. Any suggestions?

I don't think you'll win anyway. That site has enough differences that they wouldn't be judged against.

I'm not saying i's right, but to get around copyright there's only a certain percentage of the accused copy that has to be different in order to call it unique

So someone can rip a site and just change it a bit? I have hidden things in the code and images they stole, so I've got proof that they took it directly from me before making changes.

Did you look at the code too...?

Its near on identical down to image names and layout.

Why people want their website look identical to the others? Be uniques and stand out from the rest. Anw good luck for you in bringing that site down.
