cyansmoker 07-20-2002, 09:03 PM Yes, this thread title contains the word 'urgent' because I don't know how long their email addresses remains valid.
Basically I am in the process of transfering some customers sites to a different server and one of them, a british site, allows its users to upload their own amateur sexy pictures. I know that the webmaster is verious serious and the only reason why I found this picture is because it was just uploaded and, anyway, it is moderated so not available yet.
Anyway, the last file name shown by my tar report was:
lolita,daughter in panties schoolgirls,topless, white panties real, 14 years old, incest, contact for more pics.jpg
and yes the picture shows a semi-naked 14 years old girl in a suggestive pose.
Note that the pic name contains her age, the word "incest", etc.
I looked at the pic information and an email address is here, to allow others to buy more pictures.
I believe I should report this one. Do you know how/where I could do that, knowing the picture very likely originates in the UK?

kcdworks 07-20-2002, 09:40 PM Part of my day job is working in the abuse department at a very large ISP ... all you can do is contact the FBI ... wait to remove the content, as they may want to see/track it and/or view your logs.

Yes, be sure not to touch the account or any files associated with it, unless the authorities ask you to do so. I would imagine they would want to examine your logs in detail.

Be careful - doing something like that could spook them and lose the chance of gaining evidence. If you've informed the proper authority, let them deal with it, likely they have more experience with the matter than most of us.

Understand that the UK has different views of nudity then we do here in the States , what I mean is a female of 14-16 yrs old can pose topless with her parents consent . So what is elegal here is not there. Notice he said 14 and semi-nude , key wording in that sentance . Now why do I know this stuff well most of my webhosting is for models and photographers from all over the world. So I need to be on top of all the laws...
So our views here in that states about nudity need to lighten up ... But the ones doing the kiddie porn need to die... !!!

Yes they are stricter on peadophilias over there but they are also more relaxed over there about nudity . Look at all the nude beaches they have with Families going to them , nudiest camps with more families visiting them.. From what chris has posted it just sounds like the person is with in the law , again note he said 14yrs semi-nude but included the word incest to help the search engines grab his site. Now if he is showing images of these 14 yr olds having sex then he is breaking the law... All I'm saying is make sure he is doing something against the law first or a lawsuit could be in his future...

The Laughing Cow 07-21-2002, 11:19 AM Perhaps Jim, but it's not quite like that. Nudist beaches are not as common as it may sound. And are the norm in most of europe bar the UK (Ibiza, Spain etc) And the ones we do have just seem to be old people. I am not a legal expert but as I understand it, any person under the age of 18 exposing themselves is illegal. Perhaps I am wrong. I still don't think that the UK takes any kinds of child nudity or anything of this kind any less serious that the US and I would be inclined to believe that we take it more seriously.
I remember a few years back when a national newspaper had a huge campaign naming and shaming peadophiles and where they lived. That is quite severe imo.

Well in the States anyone under the age of 18 that poses nude or photographs a person in the nude is breaking the law , but over in the UK you can photograph a person from 14 on up Topless with the Parents consent.
Now what grandad is talking about is having sex with a minor and yes that is elegal every wheres !!!!! and should be stopped !! by any means ... But photographing them with what I stated above is not... So we are talking about 2 dufferent subjects. NOw on the nude beachs in the UK you will find people of all ages not just the over 18 crowd . You will find many nudist camps here in the USA with families visiting them every year and find nothing wrong with it , we all come into this world nude but for what ever reason most of the US has a problem with nudity no matter what form.
Child pornography :angry: burns me and the person or persons doing should be well I wont go there !!! but nudity in it self is just that it's all in the eyes of the beholder... We take re children to Art Gallariers do you cover their eyes when they see a nude painting or sculpture ? I hope not what about the nude photogragphy in the same gallaries . I see nothing wrong with the human body that is why I'm a photographer and I enjoy making art.....

Thats a personal thing , I guess it would depend on the parents , the use of the photograph ( Art , ect ) the 14 year old .
Now would I allow my 14yr old ? No the reason is at that age most of the 14yr olds in the states are not mature enough to handle the effects of the work . Now I really can not say how I would handle it if I grow up in a different country where beleifs are different.. Yes I do have 2 daughters 9 and 13 .

With regards to touching the account pending an investigation by authorities, I highly recommend that you freeze the account owners FTP and any other access to his site and send him an E-mail stating that he/she is under investigation by authorities and that you have no control over his account being freezing.
That would shift the blame from you and scare the crap out of them :) There should be special places in prisons for people like this.

Incognito 07-22-2002, 01:48 PM I keep seeing comments made regarding who you can or cannot shut down...and there is always someone stating you can't terminate an account unless the violate a TOS. This is not true in most cases. You can chose your customers unless you are illegally discriminating in some fashion (sex, religion, national origin, etc.) or you are, in fact, violating your agreement with them. For all these types of incidents where one wants to terminate you can write your TOS liberally enough to provide you full rights to terminate. You can provide yourself a unilateral right to terminate and to make the final decision as to what is unacceptable. I, personally, strive to protect the good, honest, ethical customer and will quickly terminate those who cross the line. I do have the right to choose who I serve and who I don't unless I have entered into some sort of a binding agreement to continue to provide them services. My terms are not such an agreement. Furthermore, my maximum obligation and liability is clearly defined as limited to what they have paid for services not rendered.
As a host, you are the one who establishes the TOS. Write it to protect yourself. And, as to those who promote illegal activities in any way, they deserve no protection and will get none from me. If this seems harsh, then so be it. Everyone must draw their own personal lines which they won't cross. One of our major problems today is "situational ethics" where we move the line at our convenience. For instance, if they are a $5/month customer we are quick to terminate, but a $200/month customer doing the same, we show tolerance.
The stock market continues to decline....and why.....because people in my chosen profession (accounting) and my most frequent business roles (CEO, COO, CFO, and other executive management) long ago compromised any ethics they had. Do you think they started their dishonesty at the top....NO....they started small and developed into big time crooks.
I set three rules long ago and continue to set them for all my employees. You should do what your boss instructs except-----no one has any right to instruct you to do anything illegal, immoral, or unethical.

I live in the UK and was under the impression that the age was actually 16 years of age. If I am wrong please do let me know and show me evidence of this.
I am also sure that the Department Of Social Service & Child Welfare would not allow a parent/s to consent to their 14 year old child to pose semi naked especially not for the purpose that the picture is being used for.

With all the nude beaches? In the UK there are only officially 10 nudist beaches that have been approved by the local athourites. It is unlikley you will find a child of 14 nude on a beach, I know I have two children and 1) I wouldn't expose them to such an enviroment 2) A child of that age would be mortified/embarresed to go into a beach with grown adults 3) Thy would be embarresed themselves to walk about naked.
The UK may have been a little slower to catch up on Internet porn of young children and the best people to contact is Scotland Yard, who have a devision for this sort of crime.

If someone has a dedicated machine in their basement (or another private place) a host can hardly shut them down.

I'll go back and find the Info on the age limit in the UK , I could be wrong but I do remember something about age of 14.
Now as for the beaches nudity is away of life for some people so having their children grow up this way would be normal for them , I know of a few families here in the states that have brought their children up in this life style. To each there own.. :) . Give me a day or 2 and I'll find the laws for the UK again, right now we are adding 2 new Rack systems and just do not have time..

Well, contrary to what they claim on their web site, the IFW doesn't seem to read their messages 24 hours/day.
I got a reply several days later, saying that they can only take care of companies, not individuals.
And several days later is, well...too late to catch anybody.
Rather disappointing, but at least I hope that this information will help you not waste time reporting to the wrong people.
