okay I dont want to start naming names, and I will wait for them to try and resolve this with me, but I was doing some research through some of the ip's in my spam logs, and started noticing a ton of spam was being sent from this same set of 10 ip's. Well I didnt think anything of it until I started digging around and this particular host has no other clients on this server (from what I can tell). And when I sent them spam complaints they told me they would be dealt with etc. So it seems to be a clever ploy to funnel the complaints to their own guys. This host has alot of clients from what I can gather, their owner has over 5k posts here on wht, and he also runs a HUGE directory that alot of you guys are paying for ads. I will wait for them to try and clear themselves before naming names, but otherwise what do you guys suggest I do? Contact spamcop? their dc? what?

That's an awfully stern accusation, given the extreme sensitivity these days about spam. How are you certain their emails are spam? Can you post a couple of examples of the emails, with clearly identifying information removed (such as company or person names, URLs and email addresses)? What tools did you use to find information about the purported spammer server?

I'm just trying to think of good questions to ask.

1) What does their ToS say in reference to SPAMing?

2) Backup all of your accounts and then recommend to do the following:

Contact your host and inform them that you will be contacting their data centre with concerns that they are allowing spamming and that your concerns are not being addresses.

The DC will probably then contact your host and get these concerns addressed. If the host has a genuine reason for this or has a problem stopping this then they will be given the support or resources to do so usually.

As a host they should have a duty of care to you. Even if your wrong/or seen as wrong you are still entitled to have your say.
