I'm just wondering what you all would do in my situation.

I'm actively looking for a new template for my hosting company (as I rather dislike mine currently), and happen to come across a guy who is selling a template with a near exact header as mine.

I don't think that header is near exact. Most hosting site looks the same anyways.

I changed my layout after viewing his auction, as I want something original rather than recycled.

In my opinion, that wasn't anywhere near similar enough to raise a stink over it.

Rasher, this isn't a copy. I see one vertical line which is similar, and that is all.

If this was a copy, then Virgin Atlantic would be in trouble for copying Swiss Air... because they both have the colour red on their planes.

If this was a real copy, the appropiate action to take would be to send the person a cease and desist, including a deadline to remove the Web site or design. If it isn't removed by that deadline, you contact the Web host (We generally go right to the top and contact the data centre).

Well I'd correct myown design. Anyway, it's a goon stimul to make your site look better!)))
