You always seem to be on top of the latest breaking domain news. I don’t think we are going to see much from this law firm, so don’t get your hopes up. Dave Zan 03-29-2007, 04:28 AM I wish there's a crystal ball smiley here, because mine's saying neither ICANN nor eNom are going to be held liable. But then, stranger things have happened. *shares  around* stub 03-29-2007, 06:42 AM Dave, you're more legally minded than me, although I know you're not a lawyer, but I think it is exactly this kind of lawsuit that is needed enjoining both ICANN and eNom to this class action lawsuit. I think they are both culpable in this fiasco. We don't yet know much details about the lawsuit but it could be a very significant and groundbreaking suit or it could simply be defeated by all the small print. It's going to be interesting to watch. Since it's a class action, presumably others can join in. Although, not being a lawyer, I've no idea if the machinations will allow this after the suit has begun. Thanks Ross. It was an interesting read. basking lizard 03-29-2007, 08:30 AM ICANN Lisbon The Dummit Law Firm announced today ... Formerly known as Dummit, Downe and Saakemin. no, not really. Dan541 03-29-2007, 09:47 AM I don't think ICANN or Enom will suffer in this case but its good to see legal action being taken. rootbug 03-29-2007, 09:51 AM Some people thought I was kidding. I've said enough :bomb: stub 03-29-2007, 10:51 AM Kidding about what? xhackr 03-29-2007, 12:57 PM I think they are both culpable in this fiasco. They are both culpable here, and should be held accountable. I wish there's a crystal ball smiley here, because mine's saying neither ICANN nor eNom are going to be held liable. But then, stranger things have happened. * I agree, but less because of the power of ICANN and Enom and more for the lack of depth of Dummit. Registerfly has removed the ICANN logo today. Will Kevin partner with an accredited registrar as a reseller and rise again like a phoenix from the ashes? Stay tuned… xhackr 03-29-2007, 01:10 PM Since it's a class action, presumably others can join in. That is the idea, but as I have said, no one should really get their hopes up here. Even in arguably successful class actions – which I don’t think this will be – the damages (in my opinion) are seldom equitably distributed. savo 03-29-2007, 06:29 PM I from start hold ICANN responsible because they stepped in too late, what did I say? Much too late. Looking and reading their letters to RF and Enom this has been a long time ago when the problem started. That time also Enom does not go free as most of the domains which were messed up belonged to them as register. No I do think it's very good to sue them all and with hope for the outcome I will wait. JJH35 03-29-2007, 06:56 PM doesnt godaddy use enom? Dave Zan 03-29-2007, 07:49 PM doesnt godaddy use enom? Nope. The tricky part is showing both eNom and ICANN were negligent in performing the terms of their respective contracts. But that's for Dummit to figure out. savo 03-29-2007, 07:51 PM doesnt godaddy use enom? Surf to them and what do you see?
