View Full Version : NEXTwebhosting won't honour 30-day $ guarantee

Heya. I just switched from NEXTwebhosting to GearHost. The reason was due to not being able to run any of my Perl scripts on NEXT's server (I was getting a 403.1: Execute Forbidden). They claimed it was an error in my scripts and that they can't help me any further.

So, I switched to GearHost and they're great. I highly recommend them (though I've only been with them for about a week now). I didn't change my scripts one bit, and they work on Gear's servers (makes you wonder about NEXTwebhosting, eh?)

But anyways, on May 23, 2002 I called up NEXTwebhosting as the technical contact for an organization (let's call them XYZ). I opened an account with NEXT, but XYZ didn't get payment to them until June 12, 2002.

On June 28, 2002, the billing contact of XYZ and I contacted NEXT and said that we are closing our account and want our money refunded. Here's the response we got:

Your account was open on May 23, 2002.
Therefore there are no refunds on prepaid amounts after the initial 30 day money back period has elapsed.
Also please note, that postal mail and fax notifications are acceptable.
Phone and email requests will not constitute acceptance of any cancellation.

So, they're claiming that since the account was opened on May 23, 2002, the 30-day money back guarantee started on May 23, 2002. I don't agree with this. From May 23 until June 12, no services were being rendered to myself or XYZ.

Also, since payment was made on June 12, that's when the 30-day money back guarantee starts. Am I correct?

I just don't see how the 30-day money back guarantee could have started on May 23, seeing as how they hadn't received any money. I mean, if I called up on June 1st and said "Hi, I'd like a refund since I'm within the first 30 days" they would've laughed and said that I haven't paid yet.

You can't get money back when you haven't paid anything! =)

So anyways, does anybody know which organization(s)/company(ies)/authorities I need to contact to get my money back and report NEXTwebhosting?

By the way, the tech support guy I was dealing with at NEXTwebhosting was Anthony Hassan, and the sales contact was Karl Sarkadi.

DON'T deal with NEXTwebhosting. They provide lousey service and won't ever bend over backwards for their customers.

Thanks, that's what I thought. How can I "rectify" the situation though, if they refuse to reimburse the money?

Call your credit card company and ask to do a chargeback. Explain that services paid for were not rendered and you should be good to go. I would suggest that you call NEXTwebhosting and inform them that you will be submitting a chargeback. Just to give them a chance to respond.

If you opened the acct May 23rd like it sounds, then no, you should not get your money back - regardless if you had uploaded or were actively using it. The CGI sounds like use of SUEXEC vs not using it - you prob had a folder w/ permissions 777 on it.

Everyone on this forum is chargeback happy.

You order cable from a company like comcast, do you think it matters if you ever turn on the tv?

They start billing you on the day you activiate your account, not the day you first turn on CNN or what not.

If you signed up on the 23rd of May, and cancelled after the 23rd of June, then you should not get your money back.

yes it starts the day of creation and remember may has 31 days no 30 in it . I say if it was created on may 23rd and canceled june 23rd ..no refund

The real question is why did you wait so long to cancel , If the service wasn't meeting your needs ? :eek:

They gave him service,its not thier fault his scripts didnt work on there server.

That is BS.. the way we do i and the way I think most hosts would do it would be say you pre-pay for hosting for 6 months. 2 months down the road you are unhappy. you would get refunded the 4 months left on the account. if there was a discount say you pay for 5 months and get 6 six would be charged the full rate for those 2 months and the remaining of the last 4 months would be returned. I have done this myself when customers want to leave due to finding a cheaper host of whatnot. as far as the 30 day mbg goes you pay for six months or one month at that matter and 30 days from the time the account is active TO YOU you re able to get a refund between 1 and 30 days.. no matter if you paid one month of 50 years ahead.. try to talk to them again and explain that this is wrong and you will issue a chargeback if you do not get a response within 72 hours or so.. and make surte to keep ahold of all emails. if they dont respond or agree do the chargeback and contact the BBB thats about all you can do.. good luck.

Nick, I'm not exactly sure what opening an account with them means exactly. Generally, you select a plan, click order, and payment is processed. Maybe you signed up for a plan and sent them a check?

I signed up over the phone rather than over the internet, and told them that the organization that I'm working for will get payment to them. They told me that until they receive payment, the account will not be started and I will not be able to use any of their services.

So, on June 12, 2002 when they received payment via a credit card, they started giving us their hosting services.

Now that I want to get a refund, they say that I can't, due to the account being started on May 23. My gripe is that I wasn't receiving any services until June 12, so that's when the 30-day mbg should begin. Agreed?

The way I would see it is "30 day MONEY BACK guarantee" means you get your money back 30 days after paying and you paid on June 12.... so umm money back then seems simple to me :)
