So what is exactly considered a breach of copyrighting in regards of web design? I mean if i use same layout for example as MySpace.com ( and there are lodsa sites that have same layout) is that breach of copyright?

if I even use same link names as other site? is that breach of copyright?

What If you use same layout, but different colors, has a lot of similar links as other site - is that breach of copyright?

i mean how do they cathegorize that?

There is some grey area as to what point you've overstepped yourself. The bottom line is this: the more original you are, the less likely it is someone will come after you legally or deliver a DMCA notice to your upstream provider and have you taken offline. If you use another site as inspiration for an original work, you'll probably be ok. If you steal or outright copy, then you'll get into trouble.

if I even use same link names as other site? is that breach of copyright?I can't imagine this would ever be a problem, unless you've copied and entire site's structure, and the links are the byproduct of having done so.

What If you use same layout, but different colors, has a lot of similar links as other site - is that breach of copyright?Maybe. This could really only be determined on a case-by-case basis, looking at a specific questionable site/page.

ok well what im trying to build is based on this site

www.rate.ee (http://www.rate.ee)

I will have same way links on left side, and some of the links will have same things in them as the links on original site.

my difference : I will have different color of entire website, even link colors, some of the links will be grouped differently and such , will have more new links and most of all links will be in different language. front page will be different, some of the mechanics will be same, just my own design. its something im experimenting on...

Again, it's really difficult to tell unless we see the final product, though I would caution you to heed my first suggestion that you be as original as possible.

Given your brief description, it sounds like what you're doing is ok, but there's no way to know for sure until you do it :)
