Good luck with the campaign Brad. I too, live in Texas and laws like this really make me think twice about running any type of online business.

Anyone who uses RS knows the Texas Tax Laws. Even those that do not live in Texas. RS taxes everyone for some reason.
Whats with that RS taxing anyway? Is it even legal to tax a client with Texas tax rates if that client isnt in the state?

Theres no federally mandated law that says companys in texas have to pay taxes on products sold over the internet. Id be curious to know if rackshack even turns over that sales tax they charge to everyone over to the state. Not saying they dont, just would be curious.

True, there is no FEDERALLY mandated tax law, but we're dealing with Texas tax law, not US tax law. If you would like to read this all for yourself, just go to the Texas State Comptroller's website at : http://www.window.state.tx.us/

(1) The sale, lease, or rental of computer hardware, including central processing units and all peripheral equipment, parts, and supplies, is subject to the sales and use tax.
(2) A taxable rental or lease can occur without the right to move the hardware if the lessee has total operational control of the hardware.

(A) An operating lease executed while the property is within the state is subject to sales tax. Tax will be due on the total lease amount for the entire term of the lease regardless of where the property is used if the lessee takes delivery in the state.
And cbaker17, collecting taxes and not reporting them and turning them over would be illegal. Taxes go to the gov't. Fees are different, but it's pretty cut and dry with taxes.
