View Full Version : Eservers.biz customers & potential customers beware!
RackMy.com 05-26-2002, 04:28 PM It has been brought to my attention that we have an issue of Eservers.biz borrowing our content.
Compare text from http://www.eservers.biz/network/index.php and http://www.rackmy.com/colocation/default.asp
Also, please check out our network diagram at http://www.rackmy.com/contact/about.asp and http://www.eservers.biz/network/index.php
Sorry to intrude!
blazenet 05-26-2002, 04:30 PM Well, I must say, it really is no coincidence that you both use 2 am as a time ;)
mdrussell 05-26-2002, 04:33 PM Now by no means am I a network expert, but surely if their network (Eservers.biz) was constructed in the way the diagrams shows, they would not have experienced the downtime that they did on Friday?
But blatant copying... disgraceful
Matt
seg fault 05-26-2002, 04:35 PM Stealing content would hardly prevent potential customers signing up :)
From what I am aware, they are only resellers anyway - so communication is a pain - email them - they email dv2 - dv2 emails them - they email you.
Hidden charges are really starting to get to me too. If they decide to play their hand the way they are, stealing web content is their last worry :)

I noticed that too. The diagram seems to be 100% redundant, but apparently 25% of their network was taken down by that one router whose cpu apparently fried.
RackMy.com 05-26-2002, 04:50 PM Really, one of the best network set-ups is to have at least 2 core routers and 2 core switches. Then you run OSPF (not BGP like the diagram) internally between your routers & switches. Your core switches should not be run at the same time, but one running active and one backup (VRRP or Cisco HSRP).
With this set-up if one router and/or one switch fails, no customers will experience any downtime.
DISCLAMER : Of course there are several other ways, but it seem like everyone I talk with sees this as the way to go.
terrastudios 05-26-2002, 05:30 PM Hey guys come on ease of eservers a bit, if u wanna bash cos of the network - bash DV2 - dont bash a firm that use the facility. If I had a server in rackshack and rackshack went down would you bash me because of rackshacks problems? Answer> No - yet your doing it to EServers
mdrussell 05-26-2002, 05:43 PM They are being bashed for blatantly copying someone else's site.
cabalstudios 05-26-2002, 05:46 PM ooooh RackMy maybe you should have contacted us, before posting on here...
Cabal Studios (www.cabalstudios.com) was our previous venture and is still online today for the customers we have still at that NOC, maybe you ought to check the network and facilities page there.....
As for the image, well I have seen that image at a few place, correct me if I am wrong Inflow(tm) also used to use the same image... I have seen it at other sites worldwide; I will keep my eyes open.
Also there is quite a huge difference between the image you have and we have, also to prove our side of this we even have the .PSD files for our entire site.... the image of the CISCO router, can be found in Microsoft Clipart....
hosticle, please email support@eservers.biz identifing yourself and what hidden charges you claim we charged you..... also we are not a reseller of DV2 we use there facility, and partnership with tranxactglobal, ask before making unclamied acquisitions.
Imran
Superior-IS 05-26-2002, 05:50 PM Also.. anyone noticed that the new http://www.dv2.com website looks like a very bad rip of the beautiful http://www.netymology.com/ website?
clocker1996 05-26-2002, 05:52 PM lol
maybe
cabalstudios 05-26-2002, 05:53 PM The DV2 site was done by an designer from WHT, i am contacting them now to discuss this ....

seg fault 05-26-2002, 05:59 PM I assume you mean accusations.
My assumption was that you were a reseller for Transxactglobal and contact dv2 for network related issues.
The bottom line is not to make accusations as such, but to point out that you guys are resellers and that the usage of other people's content - if thats the case - is not really a big deal.

You must note you are saying, that we are charging hidden fees, we'd like to know what fees your talking about, and if there hidden how do you know about them?
again, we are not resellers, if we were, we'd be one hell of a reseller business.

seg fault 05-26-2002, 06:23 PM Charging, or attempting to charge $5 per PTR record to me is a hidden charge. Especially when it is not anywhere on your website, customer is not notified upon requesting nor receiving IP's - it is only when we need a reverse entry done.
I had the fee waivered after iterating my concern with this - however, I am told I have to pay this in future.
I would consider this a hidden charge.

BurtonHost 05-26-2002, 06:40 PM OK, my two cents to this situation:
Firstly, i have seen the style of the network diagram eServers use in many places, and the eServers diagram is alot more impressive than the RackMy page, so I'm sure it hasn't just been cut and pasted, but rather using available resources.
Secondly, how can you call them resellers? If they were resellers why would their prices be the same? Why would they have the good communication with DV2 (which I know they have) and how could they afford to put as much time into support as they did.
I was new to dedicated servers last year, and through the months, staff at eServers have tought me all I know - I admit I'm not that good and was definately not that good before I started, but they have spent time, talking, helping and serving the many customers they have aquired.
If RackMy had an issue with eServers then you should have contacted them, what good have you done here apart from stir up trouble, which is the only point in your post and what you've trying to acheive. A professional would have more about themselves than to post something like this.
Potential customers, you really should contact eServers about anything and I'm sure you will be pleased with the level of support you receive. eServers and the DV2 network have served me well for the past 7 months and I'm sure they will in the future.

We have been happy with eservers aside from this recent network outage and there refusal to understand and acknowledge that their 100% SLA is bogus: http://www.webhostingtalk.com/showthread.php?s=&threadid=51461. At any rate, I contacted tranxactglobal before signing up with eservers and was informed that they are in fact resellers of tranxact. How can their prices be the same? Well they get a discount based on the number of servers they have with tranxact and I'm guessing they keep their prices the same in order to remain competitive. Now what constitutes that gray line between reseller and "partner", I don't really know, but I don't think there's much of a difference. I do have to say that their response time to support queries has been quick however.
cabalstudios 05-26-2002, 07:09 PM Richard Brodsky,
I have to say that is quite false information, you may wish to do a search, as it was asked before and Jeff stated that we are not resellers, but partners .. quite different.... **confusing**
http://www.tranxactglobal.com/partners.html
Also, we have been with DV2 before the days they launched the new server deals back in November.... We have alot to do with these servers offerings....

Like I said, I don't know what the difference is between a reseller or a partner in this case, or if it really matters, I'm just reporting what was told to me by tranxact when I called them. Now if you guys would only remove that 100% uptime SLA, you'd restore your credibility with me at least...
BurtonHost 05-26-2002, 07:18 PM I really cant see how they can survive being resellers, their support is top-notch ..... i have been in contact with DV2 staff and JH, and I was also curious at first, but it was made clear to me that they are not resellers, but partners, as the Partners page shows on the website.
RackMy.com 05-26-2002, 07:20 PM We did try to contact eservers.biz twice with no response.
Please show us where our images are used in other places so that we may also contact them for removal (we have actually contacted 2 other hosts over the last 2 weeks and they have removed the same image from their sites).
This is an image that is copyrighted by RackMy.com and was created by RackMy.com.
Cabal Studios (www.cabalstudios.com) was our previous venture and is still online today for the customers we have still at that NOC, maybe you ought to check the network and facilities page there..... Ok. Take a look at:
http://web.archive.org/web/20011025042820/http://www.cabalstudios.com/pages/shared/facility.asp - DATE Oct 25, 2001
http://web.archive.org/web/20010617204115/www.rackmy.com/colocation/default.asp - DATE Jun 04, 2001
As you can see, the network text was on our colo page back on Jun 4 2001 and on Oct 25, 2001 it does not even show up on yours.
We are not your compeditor, so please do not take this as a reason to "stir up trouble". We have contacted you twice with no reponse and just ask for you to change your text and graphic.
Thanks you.

I don't understand. What do you think tranxact means by partners? We are Miva partners, but that doesn't really mean squat. It means we get a discount based on bulk license purchases. I'm pretty sure eservers is essentially in the same boat. They do have good tech support, but I don't think they have any financial stake in DV2/tranxact. I could be wrong, but that's my take on it....
BurtonHost 05-26-2002, 07:25 PM How can you copyright a Microsoft clipart image.. or did they ask of it from you when you made it and not declare anywhere it was created by you?
cabalstudios 05-26-2002, 07:26 PM RackMy no, you have not ....
I have no emails from you anywhere on our mailboxes ....
I even looked throught the pop3 mailog, and there is no sign of you sending any emails, how strange you never mentioned it in your first post, that you contacted us with no response ...
You guys must be loving the last day or so ... getting the chance to make the most of it...

I agree. Not everyone is going to visit your forum. Also, is this in regard to the $5 charge for reverse DNS? Because eservers informed us that they are no longer charging for this. Maybe I need to double check my CC statement....
Choppy 05-26-2002, 07:39 PM Well i dont want to get into a :flamethr: war!
We have been using Eservers.biz as the provider of our new reseller servers.
We have been more than happy with them and have just ordered another 2 servers.
Back to the topic i have been around for a long time and always tracking progress of companies that i could use in the future...
Cable Studios aka Eservers.biz as one of them...
And i can honestly say that there http://www.cabalstudios.com/pages/shared/facility.asp page was there long before most others making claims of site copy.
The link that i believe was copied was displayed before in this thread so there is no point writting it again and again.
About the pic of the network well i just did a search on google 'images' and i have found around seven instances of this pic. Its not the same pic and it seems its been modified to suite Eservers.biz and there network they are partnered with.
I just hope that this isnt something got to do with spoiling a competitors reputation on this board... IF this was the case and i was not with Eservers.biz already i would consider using them even more due to the fact that maybe they have something better to offer than the people making the accusations.
I have been a happy customer and think its not fare for someone to try ' Pick at things' with a good provider like eservers.biz
About the outage nothing in this word is perfect and i know 100% sla is stated but two hours downtime or so that we experienced is nothing compared to the support and quality of there network anyway.
I have nothing further to say on this topic.
Thank you all in advance,
seg fault 05-26-2002, 07:42 PM Have you checked our forum, its clearly stated on there.
Imran,
Sorry, I don't visit businesses forums for details on pricing, I visit their website for pricing.
Hows this for an SLA: http://www.eservers.biz/about/sla.php
----
Should we fail this promise and our network is unavailable for more than 5 minutes of time in any full calendar month then we will refund 1 hour of service for every hour connectivity has been unavailable over and above 5 minutes of that month. This guarantee extends in value up to a maximum of your monthly subscription charge.
----
Correct me If I am wrong;
If their network is unavailable for 672 hours in a month - you get a free month! (minus 5 minutes)
With their last outage of 4 hours it would equate to:
$119 per month for server
672 hours in a month
119 / 672 = 17c per hour
So 4 hours and 5 minutes of downtime entitles customers to a full 70cents rebate?

Agreed. But you must also agree that the 100% uptime SLA was in fact violated.

Again, we are not a competitor so there is no hidden motive with the exception of getting the graphics and text changed.
coight 05-26-2002, 08:14 PM When I was looking for a few dedicated machines I emailed rackmy.com and no response (and a few other providers  ) . So I then posted on WHT, got a few private messages and Imran messaged me a great offer. I took up one server with them.
Then a week later we ordered another 2 from them, and we are very happy with the prompt service we have received. We are trying to move out of NO HARDWARE SUPPORT rackshack.
Shazad & Imran have been great, and we plan to have a good business/personal relationship with the guys over at eservers.biz. I would recommend them to anyone looking for a rackshack alternative.
As for site copying, it happens. The amount of times we have found our content/layout on other sites is just amazing, but instead of posting here, we send them a friendly email asking them to remove the content, usually that works if it doesnt then we come here.
You can't really do anything about content theft. They could just say they retrieved the information from another site.

If you could please let us know approx. when this happend that would be very helpful.
I am not sure if you have confused us with another rack* named host as we don't offer Linux on our servers.
MadSkilage 05-26-2002, 10:49 PM I find it rather odd that eservers has not really commented on where the image came from exactly. Although I agree that this doesn't reflect the quality of their services, IMO it is highly unprofessional to not take it down esp. in lieu of no further explaination. We all make mistakes, and this seems like such a simple issue that could easily be resolved. I hope you guys get this figured out.
Avail 05-26-2002, 11:33 PM What I would like to know is why the title of this thread is "Eservers.biz customers & potential customers beware!"? This is between RackMy and eServers, not eServers and their customers.

Superior-IS 05-27-2002, 12:46 AM I don't want to be offtopic, but are you serious? They even didn't take the time te rename some of the gifs (for e.g. shadow_bg_blue.gif of home_text.gif). Especially that home_text.gif -- it is the same freakin' size. I sure hope they (DV2) didn't pay to much for this 'template' from this wannabe designer who is only capable in changing the background color and filling in some text. Sorry, but this just pisses me off. Some bloke/gal had done some serious thinking, designing and worked out a great website. Somebody else wanders in and steals it .. and even worse.. sells it. No wonder that Rackmy.com is so upset -- I would too!

We are resolving this with RackMy personally, like all professional bodies would...
Please don’t ask, what the outcome is, if we feel the need we will post, but this has nothing to do with our level of quality and service provided... hence the topic is very inappropriate...

i am neither a customer of rackmy.com or eservers.biz
but i emailed both companies asking about dedicated servers before i went with webreseller and they were both very quick and friendly on thier pm's / emails.
i have no complaints about either of thier support teams

Because the fact that they copied (intentionally or not), doesn't show good business practice. I have no affiliation with either side, but I for one would not go with a provider who is known to blantantly rip other people's sites.
Now it may be the case that EServers are innocent, that their designer copied RackMy's text, so I'm not saying they are bad.
What I do say though is their network diagram is very misleading, after reading Sailor's post on DV2's network structure.
I hope everything gets resolved for both parties :)

A lot more that you could add to that including GREED, Integrity, etc.
sailor 05-27-2002, 02:10 PM have not checked into detail. We purchased this from someone. however - I can say that all those who jumped on the bandwagon to say that they would never have an outage because their network infrastructure is completely redunant - have in my opinion been rediculously oprtunistic. those that were silent know that you can build something that is fuly redunant - but not at those prices - what if some of these providers lost the switch that the server was connected to? Do they have dual nics running special software? NO. they would be out. We run VLAN's for extra security and to keep people from getting their IP's hijacked in the colo. We route these vlans on one or the other core routers. One core getting overloaded and or going out - will cause an outage for those that have vlan routing ahndled by that core. Our bgp is fully redundant so that if a provider goes away - then you will not notice it except for the momentary reroute. MOST providers know all this and that is why they were professionally silent and courteous - they are all pretty amzing competitors and a nice group to be around.
Now as far as the web sites go - I dont know about all that - except to say that much of the wordings out there are similar and if someone blatantly copied it - they sould change it into the qppropriate rewording to be customize - but we all do the same thing and there are only so many ways to say it - I am sure that someone will take care of this. I paid money for it and would not want to be considered someone who just rips people off becasue that is not hte case. I also have worked with eservers for some time now and can say that they are great guys and are very trustrworthy.
I give all the benefit of the doubt and I am sure it will all work itself out. I have seen other opportunistic bashing going on this board - and I have also seen the nasty consequences for those that start it - this board seems to be populated with an extreme amount of intelligence and it is highly unlikely that any one will not see through funny tactics.
Just my 2 cents. I think everyone is doing their best and generally speaking all do a great job. (including my competitors :) )
RackMy.com 05-27-2002, 05:47 PM It has been brought to my attention (by www.cabalstudios.com in a conversation today) that the cloud in our diagram was indeed clip art. I must apologize for this as I don't remember that coming from another resource. (you can see a sample at http://www.rware.demon.co.uk/images/rsrb_2.gif).
I was wrong about this and I do apologize, however the network diagram is still copyrighted by RackMy.com and is an original.
If anyone can show me that our routers and/or diagram comes from another site, I will pay you $100.00 in cash! I would like to get this resolved, so please PM me with URLs.
Thanks!
mwatkins 05-27-2002, 06:15 PM Actually the cloud is not clip art - it is a standard VISIO object from the VISIO "Basic Networks Shapes - 3D" stencil.
I had a quick look through other Visio shapes and was unable to find one that looked quite like the Rackmy router objects on the diagram, but that doesn't mean they don't exist in Visio. The enterprise package contains thousands of shapes after all.
Alexoid 05-28-2002, 03:59 AM Interesting thread, seems to have forked into a couple of different discussions tho. I stumbled accross the forums on our stats (for netymology.com) when we got over 100 referals in one day. That's usually how we notice about people using our design in some form or another.
Anyway, I've contacted someone on the board that seemed to know the people responsible. And once again, it gets found out and the company gets more hurt by community bad-mouthing than by anything we would undertake. We've found over 20 replicas of the site (in varying colour schemes) which have all been shown to us by people just browsing or posting in forums. The site has been "rebuilt" in Turkish, Russian, Taiwanese, French and lot's more. Sometimes it's more fun than annoying, sometimes.
I guess it's the same thing with that network diagram, clients and potential clients won't really care about who copied who unless its blatantly obvious. Nobody gets out clean...
I hate to see all this, especially when "designers" pass on other peoples work as their own. Most people signing the checks don't even know about it and only see a decent design. The company can change it's site and get on with life, the designer does stand the risk of getting stuck with a bad name. The word travels faster than you'll ever know.
Best Regards,
Alex Schleifer
