Is false Advertising a crime act in the US, for example a car manufacturer does a marketing campaign where is stated that his new WBM Z3 :) can reach at least 380 km/h (sorry have no clue with mph ) but he hopes that no one will acctually try to drive so fast. ? Any law students around?

Yes, you can't advertise that the car can go 380 km/h when it can't, or has factory placed limitations to prevent that. Any car could go that fast if you strapped on jet rockets to the roof ;)

So anyone can sue hosts with unlimited bandwidht? Are there any really big companies that have unlimited plans? ( remember Phillip Morris and that cancer story) I wanna get rich :)

I would asume if you can "prove it" You can prove how fast a car will go

Well if i sort of make a 1 mb file and than let 1 out of 10000 people that use the internet to download it once a day, host would at least break the SLA most have that 99,5 % uptime thing
or kick me ( i would have just one simple html file and a link for download, so no mysql+php+vbulletin cpu intesive stuff) ?

Realize how much money it would cost to sue someone verses what you'd actually win in the settlement. Philip Morris' products killed people or made them terminally ill (the argument). This is quite a bit different that a host not being able to provide you with the advertised services.

Yes, but person that had troubles with too hot coffee in Mcdonlads, also didnt died but got a lot of money, and if i get some Psycho-Doc to prove that I'm having nightmares because of host not providing me with a promised and "advertised" unlimited bandwidht for 6 $ and arange 50%-50% with a lawyer...hm

Im interested in sueing an unlimited company. I have been threaten by countless numbers of them, and some even threaten to sue. Nothing has come of any of the threats, so maybe I should threaten to sue them.

Any lawyers out there wanna go in with me, ill give you 80% of whatever we make. I just wanna get unlimited bandwidth to be illegal.

"Unlimited" has implied limitations just like "all-you-can-eat" buffet. Read the contract. If you violate any part of the contract with the hosting company, then they are not obligated to give you "unlimited" bandwidth.
