Hello All :)
Is it illegal not to take backups of your client webhosting account or clients should take there own backups?

I highly doubt that it's illegal as long as you don't misuse, sell or leak the data present on your client's website. Most shared hosting clients would actually appreciate a host that regularly backs up their website data. Make sure you include this in your TOS & have the client agree to it when they signup.

There is a little known US LAW, and I do not have it right off, but its based on the type of the business that has the hosting account. i.e. if its an Corporation or LLC. That if a backup is made, and the client becomes deliquant in their account, by law you are required to keep their files for 30 days. I will dig out the law and post soon...

hmm what does this mean? does it mean that its the company who is offering the client a webhosting space to make backups off all accounts 0_0 !
It's not illegal to not make site backups for clients unless you claim you do and do not. That would be fraud, I believe
@EVILICIOUS, I think you might have misread? Or I have..

I think he's trying to say, legally must he backup client's data. If you tell them you will and you don't as Bear said then it becomes illigal. As long as you specify what you are going to do and stick to it there is no problem.

I think you should speak to an attorney about it and not take legal or tax advice from non-professionals...or you could find yourself in deep doo-doo.
