Court Grants BulkRegister's Request After Agreeing Verisign's Marketing Campaign Is Deceptive

Baltimore, Md., - May 14 - Following a two-hour hearing this morning, BulkRegister, the fourth largest domain name registrar, won a preliminary injunction against VeriSign at the United States Federal Court for the District of Maryland.

The judge agreed there is sufficient evidence in the case to prove that VeriSign's recent "Domain Name Expiration Notice" marketing campaign is deceptive. As a result, BulkRegister was awarded a preliminary injunction. The court found that BulkRegister as well as its registrants have been injured and would continue to be injured if the campaign proceeded. Additionally, the judge said VeriSign or other third-party entities must immediately discontinue deceptive transfer, renewal or expiration notices to BulkRegister's customers.

"The injunction against VeriSign is a definite victory for millions of domain name holders and fellow members of the domain industry," says BulkRegister's CEO Tom Cunningham. "BulkRegister is committed to seeing this matter resolved on behalf of our customers as well as the domain name community at large."

BulkRegister was prompted to take legal action against VeriSign after receiving communication from its member customers about the deceptive notices. VeriSign's "Expiration Notices" had an artificial "deadline" for reply of May 15, 2002, with the implication that the domain name was about to expire. However, there was no relation between the reply deadline and the actual expiration date of the domain. An uninformed response to the notice would result in the approval of a transfer of the domain name to VeriSign. This practice, know as "slamming," can result in a loss of domain name services (web access) associated with the domain, as well as differences in quality customer support offered by BulkRegister.

One of my clients got this email and almost signed up and renewed it - but I told him to not do it.
I registered his domain for him, so he should not have had ANYTHING like that.
It isn't even close to renewal date!

It's not just Verisign. I have a domain at Yahoodomains (I know, don't flame me! :stickout ), and I have gotten paper mail solications from Verisign, Interland (twice), and register.com. Verisign and Interland were offering high-priced renewals, while register was offering a pretty decent discounted pacakge.

I had a customer who's domain got switched over and they sent her a letter with her account info and so on. The thing is, they *say* they never approved anything. We have since put in a transfer to move it back and we are gonna eat the cost, but still, it is such a pain. I am glad they are finally doing something about it. Especially when you have customers that are not that savvy when it comes to anything with computer/internet/web issues. Sometimes, they dont know any better.
