Hello,
if someone has registred his domain on a fake name and adress, is this domain valid? Or can i write to internic that the current domain owner does not exists and i want this domain?
I noticed on almost all the registrars TOS that if you don't register with the correct information that it isn't valid. Not totally sure though. Who is the registrar?

If you have a UDRP claim on the domain - ie it's a trademark violation either through a legal mark or a common mark - you can use the UDRP process and file a claim on the domain.
If you simply want the name cause you like it, and it has false registration information, you cannot "tattle" on the owner and claim the domain for yourself.
What you can do though is contact the Registrar and complain about the false contact information. They are under contract to ICANN to address any complaint and to get the information in the domain corrected. The Registrant has 15 days to do so. If after 15 days the information has not been cleaned up, the Registrar can drop the domain.
The dropped domain would be available for anyone to register.
This is the "legal" process to follow. Your actual results may vary.

the domain is registrated with directnic.com
but uhhh... itīs very hard to get some serius informations about that theme. maybe you have to :cartman: go to a notary to have a real evidence that it was registrated on a fake adress and name!
but anyway thank you all!!

Notify the registrar. It is their responsibility to determine if the information is accurate. All registrars should have a provision for this in their registration agreeements.
It's the responsibility of the registrar to make sure that the registration is accurate, and they're required to that under their agreement with ICANN (for, obviously, the TLDs to which that applies), but that doesn't mean they will. Clearly the registrars have no reason to think of ICANN as some aggressive enforcer of the rules -- as the many fraudulent and abusive activities of certain registrars make clear. I wouldn't think any registrar would worry that being slack about this requirement would bring any retribution from ICANN.
Could be worth a shot, though... so go ahead and make the complaint. But I wouldn't start holding my breath too soon. :)

I just read soemthing today about this where they are trying to pass or did pass a law requiring Real information before a domain can be registered.

How does one determine if the data used is fake?
How do you determine that the data is accurate - phone calls, snail mail?

Very Good Question??? I guess the registrar can deny letting someone sign up if they want if they think the info is false?
Who know.
Maybe the credit card and the domain registration owner has to match.. I don't think it can be enforced that well
