View Full Version : Our hosting domain infringed - options?
NexDog 05-03-2002, 09:47 AM Hi,
I know I should have registered the .net a long time ago but I just didn't get around to it. I just went to register hostnexus.net and someone registered it 3 weeks ago!
By pointing your browser to http://hostnexus.net you will see that they just took it to sell it - to us probably. I'm not a happy camper. Scum, opportunist cyber squatters like this seriously pi$$ me off.

Hostnexus INC huh? What a crock. What are our options? What would you do in our place?
Zorbs 05-03-2002, 09:54 AM I had the exact same problem last night. I have a solution but would rather not post it publicly. PM me for details.
Chicken 05-03-2002, 11:49 AM Laurence, hold the mayo for a second. Your domain wasn't infringed upon. Another extension of your domain was registered, there's a big difference. My guess is that you haven't registered the many extension of your domain that are available.
At this point, you're only option is to make a bid for it (if you want it), unless you're considering petitioning ICANN regarding the domain.
Available:
hostnexus.org
hostnexus.us
hostnexus.info
hostnexus.biz
hostnexus.bz
hostnexus.nu
hostnexus.ws
hostnexus.cc
hostnexus.tv
etc...
You aren't going to register them all (I'm assuming), so don't worry about it. I doubt putting a 'tm' next to hostnexus on your pages will offer you much protection, but it might be enough to prevent the buyer from using it to offer hosting services. Talk to a trademark lawyer on that one...
jmc67 05-03-2002, 04:11 PM Is it me or does the women on the bottom left have her head severed? You need to take a look at this and fix it.

It looks like that graphic is sliced, and the top slice probably didn't load for you. Try reloading the page.
Hmmm... when you look at the bottom graphic only it does look rather gruesome :eek2: http://www.hostnexus.com/images/left_man2.jpg
4solutions 05-03-2002, 07:21 PM Here's what I would do:
(1) Immediately add an "sm" for service mark or "tm" for trade mark to your name, HostNexus. Then send them a demand letter by certified mail informing them that you have used the HostNexus name in active international commerce since March 10 of 2001. Tell them that you intend to file a domain name dispute mediation suit with ICANN unless they cease and desist using the name. However, because it usually costs over $1,000 to do this, you are threatening this mostly to make them sweat.
(2) Have a friend or trusted party who cannot be traced back to you make them an offer "out-of-the-blue." Currently they are looking for only $100.00 USD. Give them their little profit and then chalk it up to experience. It would be best if the person making the offer was in another country than you (I'm sure that several of us here - including me - would be willing to help if possible).
In another thread, we were all suggesting that every host should not only register the obvious .com/.net/org etc... but also the hostname + sucks since these names apparently show up in the search engines, too. So, you might want to register HostNexusSucks.com before one of your disgrunted customers does.
Best of Luck,
Keith
PS... PM me if I can help.
NexDog 05-04-2002, 03:12 AM Thanks everyone for all your advice. I'm going to talk this over with my partner and see what course of action we are going to take. A hundred bucks is not alot of money, it's just the principle....
Chicken 05-04-2002, 04:53 PM Well, you could look at it this way (I do)...
If that site ever gets popular, they will surely send you loads of hits, as *you* have the coveted .com version!!! :D

Thanks Chicken, I needed that. :) :)
Incognito 05-07-2002, 09:41 PM I never worry about someone having the .net to my .com. In fact, I would hope they would advertise and promote like crazy, because I know I will get some free visitors from it.
Example: I have owned a certain .com for quite a while, but not used it....only has the apache default page. Someone more recent bought the .net and has done quite a job promoting. In the last 30 days I got over 5,000 visitors encouraging me to build something and get the site active. Brought site up on Saturday. In first 4 days have had 900 visitors and made 9 sales to customers who had no inclination to even be there. Thank you my .net friend.
Techark 05-07-2002, 09:50 PM so do a search on the dept of fair trading site and see if there is a company that is using your name there. If they really are in OZ and using hostnexus inc as a business name and you have your registered you can file a dispute and they could be fined.
They might be willing to sell you the name for cost to avoid the DFT hassles.
Or pay the $100.00 and chalk it up to experience.

Get someone in australia to dial (02) 9493 0492
Also e-mail support@zoneedit.com and get ZoneEdit to remove DNS services for the domain
bellyache 05-08-2002, 04:12 AM I don't think there is anything you can do about this except offer to buy it from them.
hostjet 05-08-2002, 06:31 AM Also e-mail support@zoneedit.com and get ZoneEdit to remove DNS services for the domain
i dont think zoneedit would do anything.
I wouldnt worry at all, if anyone built a site using the .net, like chicken says, they are going to drive extra visitors to your site.
In my opinion I would be glad if someone developed the .net and started sending me free traffic.
I dont think they will sell it, and if you ignore them, you may find in a year that they have let it lapse.
