View Full Version : Looking for a good TOS!

I am currently running a hosting service through a shared server/reseller. I am looking for a good TOS contract. I am about to sign my first client, and although he is a friend, I want to cover all legal aspects. Anyone know where I can find a good generic TOS?

Lubby 10-27-2005, 09:38 AM Few options. Obviously talking to a lawyer, however many won't know much about internet TOS. Another option is talk to the company you get your space from, a lot of times they will allow you to use there's since your customer must follow there TOS as well. Be sure to ask though. The other option is occassionally I have seen users in the advertising sections offering a TOS/FAQ/Etc system for a fee. Try searching or looking around down there.

WO-Jacob 10-27-2005, 09:55 AM I would definitely recommend checking out HostLegal (I believe the url is www.hostlegal.com though I could be wrong), at least for a starting point. You could then make any modifications you need, and then have a lawyer look it over and ensure everything is proper.

They provide a complete package for TOS/AUP/PP and countless other forms and such. They will also to custom jobs for you ranging from creating forms you need, to making excel spreadsheets to govern finances, projected price plans, etc.

Not specifically what I suggested, but if you don't mind just having them make the modifications and paying for it, i'm sure it still saved you a chunk of change. :)
Be sure to let us know what your lawyer thinks of them (general terms are fine), always good to cover more perspectives.

What wouldn't be better than see a TOS from some reputable company?
It might just as well reveal some problem area you'd miss otherwise.
Then go thru some of them, and take notes, then write your own from those notes, and read it again and again for 5-6 times, once every couple days and fix errors you notice (you won't notice some errors by reading it again and again in a row).
Then pass it to a lawyer to make sure everything's allright with it, and non of your terms goes against some trading law.
