View Full Version : legal action against organisations that post lies about your company?
Does anyone here run a Law company or something
Thing is i want to take some legal action against a certain organisation who is posting nothing but lies scandal and false statments about my hosting company
i dont run it full time its like a part time thing for me i got a full time job i do hosting i just do as a hobby
so now some organstion decides to publish my hosting company ridiculing it and posting nothing but nonsense and garbage and to some extent it has effected the ontake of clients and ive had clients dropped out cos of what they read
Im based in UK and this organisation is overseas
can anyone point me to the right direction ? or if anyone here is a lawyer or willing to take up the job or point me towards the right way that be great
i dont have my own lawyers or anything!

We are all aware of the Internet as a freedom of speech tool, you can post anything you wish.
This whm forum is perfect example, if you look at all the complaints that people post it just amazes me.
I would ignore the posting and don’t stress about it. If you worried what everyone thought about your business then you would be working and explaining your actions 24/7.

boonchuan 10-27-2005, 09:11 AM I don't run a law firm but I did a check before, I think Singapore laws should be similar to UK laws. The costs of such a civil suit would kill anyone but the richest.
etechsupport2 10-27-2005, 12:34 PM If you offer good service and support to your customers and having good control over them you should not worry about those false statements, instead of bringing legal action against them you should concentrate more in your business that will yield good result.
The Stealthy One 10-27-2005, 05:37 PM Unfortunately, being over international boundaries, there is probably nothing you can do from a court standpoint. You could try to discover who hosts their site, and contact their host - that might get you somewhere.
Good luck! :) And don't let it get to you - unfortunately, there's always some scumbag out there who's out to get you - I've finally learned to just ignore the ones who come after me...it took awhile, though! :)

You could contact their provider and ask them for assitance. I'm not sure how far that will get you since they aren't doing anything "illegal" but it's worth a try.
mythologen 10-30-2005, 05:22 AM it isn't necessarily legal to post your opinion. don't get me wrong, i have no law experience, but i believe you would have a legit case for libel, if their claims are not based upon their experience, or are otherwise unwarranted.
it would definately not be a cost effective solution to take legal action, IMO.

Not exactly....
The internet is a freedom of speech tool, but that does not mean you can post lies. That would still fall under the tort of libel (or spoken, slander).
The greatest example of this is section 1 of the Canadian Charter of Rights and Freedom:
Rights and freedoms in Canada 1. The Canadian Charter of Rights and Freedoms guarantees the rights and freedoms set out in it subject only to such reasonable limits prescribed by law as can be demonstrably justified in a free and democratic society.
Now I realize this would not apply to you, but I can't think of a country where free speech is 100%, and you can say whatever you feel like.
There is nothing wrong with posting complaints, but if you make up lies to damage a companies name you better watch out.
I'm not a lawyer, but I am taking a comprehensive legal course right now.
I'll soon be working in a law office as paralegal.
Yash-JH 10-30-2005, 12:47 PM If you can prove that the person posting the information is posting lies and is defaming you, you have a case. However, if the person making the claims can prove what he posted is just an opinion based on his experience, it would be thrown out. So to really sue someone over any sort of comments, you must be able to prove it is willful lying and defamation, and not simply an opinion. You must prove 100% that the claims made in the statement are 100% false.
It's best you contact a lawyer... Normally, a legal notice would be enough to take care of matters if they aren't responding to email or are stubborn. Pursuing a defamation case is not cheap, but then again if its hurting your business interests, its well worth pursuing.
Also, WHT is simply a publisher of information. They are not necessarily liable for the content posted here. However according to my understanding, they'd could be forced to release information about an account/person who a company wishes to pursue for defamation. This would be under court order.
