Hi,

Just wondering your thoughts.....I registered a domain name about 2 weeks back(an expired yahoo name - gets fair bit of traffic)and now the bloke that owned it is threating to take me to court etc :/ thing is ... its not trademarked,the bloke said i stole it from him...hmmmm i thought i paid to register it actually. Anyway do you think i should sell it back or just keep it? The bloke seems pretty annoyed and what i was thinking was if i give him it back is he going to try and get me into trouble anyway?because he sounded like he would do that :/ Dont get me wrong i could see why he would be annoyed,but then again with a recurring annual fee of $299 its kind of stupid to let it become available(i can see that slip ups may happen as well due to change of email or something)

Darren, dude... that guy is incredibly stupid. If he didn't want anyone to register the domain name, then he should have thought twice about that before letting it expire.

There is nothing he can do to you in court, or anything else for that matter. When that expiration date hits on a domain name, it turns into a first come/first serve basis, bud.

So, in conclusion - tell him to shove it!

if someone comes to you in a reasonable fashion and explains their situation, and offers to buy it, for a modest amount, you feel somewhat inclined to respond in a reasonable manner.

But when they come to you with acusations of theft and legal action straight away, i would be inclined to do as JedKent said and "tell him to shove it!"

Hard to comment without knowing the exact details, but even though there is no trademark, he still may be able to get the domain name back, however it would no doubt cost him quite a lot in legal fees.
