I use (assume abc) for my online business. Actually i have plan to start company with the same name. But till the company formation i want to protect this name from theft. So i have decided to register my trademark.

I have no previous experience in trademark registration, will you please help me how i do this.

I heard about law companies which can do this but still unsure about its process. Another thing confuses me a lot. I am from Pakistan, i use name abc for my online business (assume it is registered trademark) and someone from canada use the same name for his/her website. Can i sue him. Or if he is using the domain name which is my registered trademark can i take this domain back from him through domain controlling authority.

The first thing you need to do is to find ot if your business name can be registered. Some names that are considered too generic or "ordinary" cannot be registered. For example you can call your business "ice cam" but cannot register the name.

Assuming the name is registered you can take action against anyone using the name in the country where it is regisered. So if you regiseter in Pakistan you can't take action aginst someoneusing the same name if Canada unless you register in canada as well. The excpetion would be if the name is an establish global brand, Coca Cola for example.

The same would paly to domain names. Recognised global brands cannot be registered except by the brand name owner. Under certain circumstances domain names can be taken back. Suppose you registered TomCruise.com then Tom Cruise would almost certainly be able to get that name back.

If your campany is called "XYZ Enterprises" and someone happens to have registered XYZenterprises.com then you will have to buy the domain name from the registered owner.
