View Full Version : Can you explain why this site uses our design?
Weevox 08-23-2005, 01:43 PM I would like to get the attention of WHT member CSDesk (http://www.webhostingtalk.com/member.php?s=&action=getinfo&userid=78179)
Take a look at Speedo Space (http://www.speedospace.com/shared_comparison.php). This site is using our design for http://www.advancedcolo.com/weevox/ without authorization. This design has been sold you Bill McKissen and we have the contract and invoices to prove this.
We have learned that the domain name speedospace.com is registered by CSDesk from this post : http://www.webhostingtalk.com/showthread.php?s=&threadid=359262&highlight=speedospace
If you take a look from my sale thread, CSDesk is insisting that I am reselling this design. http://www.webhostingtalk.com/showthread.php?s=&threadid=406241&perpage=15&highlight=wixen&pagenumber=2
We sent a DMCA Notice to Speedospace and Indous hosting but looks like we are being ignored here.
You must wonder, how we found out. Well, whoever did this was stupid enough to leave my name and link it to my website. :o
Prophet6 08-23-2005, 02:17 PM I am the rightful owner of this design. I purchased this design from MaryLuc @ Weevox Studios in June.
I have not had the chance to complete my changes and launch the site.
Whomever is the owner of the domain speedospace.com needs to bring this site down immediately! It is an obvious download and Photoshop rip off of a design that I have purchased and own the rights to!
humm...looks like I have a buisness arrangement with the owner of the datacenter speedospace.com is located in. Maybe I need to make a phone call.
Whomever owns that domain has 1 day to get the design down. PERIOD! Hiding behind anonymous registration is not going to save you.

atchoooo 08-23-2005, 02:38 PM This looks like a template that can be found on templatemonster.com ... maybe someone sold you a modified template from templatemonster. Templates are not unique, so anyone can use the design unless you buy it as "unique" but even then, when you buy it as unique templatemonster stops selling the template but other people that bought it before you can also use it.

Prophet6 08-23-2005, 03:11 PM The design is not a template from templatemonster. If you even bother to check you can see that the mouseovers ( left side navigation) on the design I purchased work. The same area on the stolen design on speedospace.com do not.

I don't mind you defining it looks like a template monster design because TM's designs are actually pretty good. Actually I think they are one of the best. Not everyone, here can produce such quality. ALL our work is created from scratch. And we have everything to prove it.
stripeyteapot 08-24-2005, 05:54 PM It's unfortunate that they took parts of your site and recreated others, however posting in a public forum which they likely won't read isn't going to get to far.
Have you sent a cease & desist letter? It's often that an eMail can sort this sort of thing out, however having your legal representitive write and send out the letter is much more effective.
As these documents, and all source files have been purchased, I assume that the rights lay with the client, in which case is the party that should contact their legal respresentitive(s).
You mentioned anonymous registration, so do they have Nameservers? Talk to their host. I strongly recommend doing this with a legal advisor, since if you cannot prove it you could be liable for damages (Yes it happens).

First of all I apologize for not replying to the post because I am not THAT regular on WHT since last few weeks cause of work load.
I have checked your mail and I must explain this situation.
I dont know who he was but a guy read my post on WHT regarding a design I needed and he told me that he has the full rights of this template / website and he wanted to sell it in $100 ( 10 Pages )

$100 is a very very small amount for this lovely site so I told him to show me the PSD and other files, believe me he showed all the files and he sent me the entire folder with coded designs etc but luckily I kept it in a corner cause I did not get the chance to use it really.
check the site and you will see its just a design and it has NOT been used yet.
I dont know what else to explain cause I dont know whom should I trust? You or that guy who sold this design to me.
Thats why I had mentioned in 1 thread that this design was sold.
Anyways, I am ready to sort out the problem. I am not going to let this design go cause I have paid $100 for it.

Weevox 08-25-2005, 03:59 AM It is not our problem if you have been scammed by some blankcall69 guy. Just by comparing these 2 sites, who do you think is more believable? Do you think anyone would sell such quality for $100? Come on now! I'm sorry but I don't think there's anything you can do but to hunt that guy and ask for your money back. We have all the rights for this design. And we have the right to request the removal from your site. Email me all your proof that you have the authorization to use this. Email me all the files too. Shall you refuse to remove this, we wil be force to take action against you too.

But I guess you should read what the current design owner ( prophet6 ) has written in the PM. Check the Attachment.
According to him its a STORY. :)
I apologize for the entire episode, it was my mistake that I did not ask Maryluc if she has sold that design to someone or not and I did purchase it from someone else. He said its a different design inspired by Weevox's design.

It is good to see you are taking the proper action in removing the site.
This could have been handled earlier if you would have replied to the DMCA's that were sent to you. It would have never reached the board if you had done so. You decided to ignore them though. That was your choice.
Also, private messages are called private messages for a reason.
If I meant for that to be posted in the forum I would have done it myself.

Just wondering if you may have had a chance to consider how your communications and tone might have effected your image in this forum... as it is filled with some pretty decent and respectful people, none the least is the person you are at odds with.
While you have a right to be upset, You may want to offer some kind words to the forum. You will not find a stronger more professional and helpful bunch of guys (and/or gals) out there, and I think you may have un-intentionally bruised your image here a bit with the heavy handed tone.
I think it is good to have pride in your work, and you are obviously proud of your site. (I like it by the way). but they say, Pride goeth before a fall.. so I thought I would trying to talk you down off of that ledge. <Smile>

But this is a matter of ownership, and I don't believe for a moment anyone's image is tarnished when they open a thread demanding their rightful property be returned to them and they word their request sternly. This is the type of situation you nip in the bud, and I think it speaks volumes that MaryLuc is so tenacious, as this means she's protecting her customers to the best of her abilities. I think it's equally appropriate that the customer (prophet6) is protective of his property. You don't dance around a criminal issue such as this or send out warm fuzzies to the perpetrator. You handle it quickly and effectively, just the way it happened here.
The only time it becomes an issue again is if the stealing happens again...or if someone dredges up a closed issue to comment on the victim's demeanor. There's an easy solution to this though - topic closed. MaryLuc, if you need it reopened, just contact the help desk.
