View Full Version : Where did you guys get your TOS from?
poncho2000 04-01-2002, 05:34 PM My site is almost ready and the only think left is TOS.
Where did you guys get your TOS from? Did you copy them from the other hosts, or you paid to somebody to write them for you?
Any help is appreciated,

Andyc 04-01-2002, 05:47 PM As a reseller I am using the ToS of the host I am reselling for. For those of you that are going to jump on me for doing this I did ask permission first. They encouraged me to do that so there wouldn't be any conflicting information.

SoftWareRevue 04-01-2002, 06:10 PM Most any host will let you use their TOS, if you ask.
But, if you are reselling, you would be wise to use the host's you're reselling for.

scslawin 04-02-2002, 11:36 AM If you're reselling and can use the provider's TOS with permission, that's a very good way to go (if you agree with everything therein).
If not, take a look at others around the net. Create one based on what you've seen -- dont' copy one -- and have your lawyer review it.

Everyday 04-02-2002, 11:57 AM We printed out about 10 of the TOS from the bigger hosts. Crossed out and added then had our lawyer take a look at it and write it up. Using the TOS from another company is not bad so long as its for reference. You should not copy it word for word. Rather get an idea of what subjects you want to have in yours.

Best advice I can say is to take the TOS from your hosting company and modify it. For example, if you are a reseller, all of your accounts still have to follow the rules setup by the mother company. Simply take it and modify it. Most compaines are okay with letting their clients use their TOS.
Starhost 04-02-2002, 03:39 PM Just ask the TOS of another company and of your mother company. And then chose the best TOS and change it to fit your needs.
Of course you have to ask if you are legible to use the TOS of the other company!
decebal 04-02-2002, 04:17 PM I agree compiling a TOS from your provider(s) with best hosts. Also if you considea a SLA you should go somewhere below your provider's (just in case).
If your target it country specific try to find out what the laws in that country specify (copyright, personal information, privacy, child protection) and do make a translation.

kunal 04-03-2002, 05:25 PM i would use some other hosts TOS only as a reference. Because your policies do not have to match that of the host you are refering to. Plus, the laws in your state would differ.

It’s from the DC law firm Marzouk & Parry. I had a lawyer touch it up to ensure everything was how we wanted the tos to be.
