Looks like I'm going to have to contact your registrar about this - I've had lohosting.com and .net for almost 6 months, and then I find that you've taken on low-hosting.com

low-hosting and lohosting may be spelt differently, but they are pronounced exactly the same.

Therefore, I have a legal case against you for the violation of my trade name.

I cannot believe the ludicrousy of your claims. What you are saying is that since we have similar pronounciations for our companies, I have a violation of your trade name. Here's my question:

1) Are you suing lowhosting.com, hosting.com, lowhosting.net for their names?
2) You just registered at this board I have been for much longer. There is no way I am stealing your idea for a name
3) You have no legal claims because:
a) You have no proof of damage to your company
b) You have no Trademark of your name registered, as a matter of fact your company site doesn't even have a copyright notice!
4) Continuous frivolous claims and such non-sense will be responded to by my lawyer.
5) Since I'm not selling your domain name to you and using it for my own, you have no claims with the registrar either.

Good luck on your future endeavors. I think you have damaged your credibility more than anything else.

That's ridiculous. He has no case. First, low and hosting are both common words. So what if they're pronounced exactly the same? If you started a computer company named Appull, does Apple have a case against you? As long as you're not intentionally trying to hurt his business, you should be okay. If he was concerned, why didn't he register the domain name himself in the first place?

I agree with ToastyX. Look at all the resellers on WHT. Many of them have similar names. It's all just common words of the business.

There are a few very succesful companies out there who don't own all the tlds for their name.

In fact most online domain search engines offer you option of various spelling etc...

Lo / Low ? tell em they reached rock bottom ;)

Also, people say their going to sue all the time - but are they willing to pay the lawyer fee's to sue someone? They're going to get billed for at least 2 hours, 1 to make the complaint, and one to file it.

Dear Turboz,

I am not an expert in legal issues, but I think I have a definitive answer and solution to your situation:

If low-hosting, in addition to registering low-hosting.com also stole you pale and other toys in the neighborhood sandbox - sue him, otherwise graduate to the first grade...!

Didn't Reggie Jackson trademark his "Mr. October" thing?
