View Full Version : Legal action to get refund on unathorized fees?

I have a situation with a previous host, in that they owe me $150 for extra billing charges dating back all the way to last November. I have everything well documented and their admission that the charges are incorrect and that they will be refunded as soon as possible. It has been over a month and I am getting the run around. I was just told today that someone in the accounting department was told to make the refund, but they must not have gotten around to it, so they will do it personally within the hour. It has been four hours and I doubt it will be done.

On a side note: It is a small company and I do not believe that they even have an accounting department since the person that responds occasionally from that department has the same writing style as the owner and I have verified that the email to accounting@ and owner@ (owner being the owner’s name which I am not disclosing at this time) goes and is checked at the same computer.

So here is the question… is it worth $150 to take legal action? If so, my next contact with them will be threatening this action. I will not make the threat unless I plan to back it up. Will I need to hire a lawyer for such a simple open and shut case. Will the court costs be more than this? I do not want to end up with a legal bill more than 150, but it is a matter of principal now and I do not want them to end up with the extra money. If it matters, we are in different states: myself Kansas, them California.

Any advice would be greatly appreciated. Thanks!
