Hi,

I have found that one reseller is registaring the clients domains as his domains. Is this legal?

I would imagine that it depends on what kind of agreement he has with his hosting customers. If they are made aware of this practice and agree to it up front, then I guess it's a matter between the reseller and his customers.

Personally, as a reseller, I wouldn't want the liability. If customer x started saying terrible things about, say, MicroSoft, Inc. , if I was listed in the whois as the owner of the domain, then I expect that I would get sued also.

Lawsuits are expensive and time consuming. Avoid them at all costs. Even ridiculous allegations where you have done nothing wrong often require you to defend yourself with the aid of an attorney. They eat up your time, your money and your energy.

If your reseller is say, offering offering a "free domain" with his accounts that he is buying for the client then it would have to be in his name. Even if he is simply buying the names on their behalf and they are reimbursing him for them the information would have to match his credit card. I would hope that he would transfer it to the client after being paid if this were the case but as stated before I guess it really does come down to what the TOS says.

This is a good question.

If I were to use 123-reg to register domains, I could register them under my account, and put the users details in as the registrar.

What happens thoughif the user wants to take their domain to another site and want it released? - Would that mean they would have to access my account? - Would I simply have to reconfigure the DNS settings every time they move from one host to another??

I was offering free domains with yearly payments a while back and I registered the domain names for them put there info for the account but it was on my CC. The only way to get it out of your account is to transfer it. For example I had one customer who wanted to transfer it because the year was up and he wanted to go to godaddy.com for $8.95 opposed to my $14.95 so I did a transfer to godaddy for him and he put it on his cc info.
