I just wanted to ask some of you seasoned web hosting providers out there if this sounds like a good TOS/AUP. Please reply and tell me of any shortcomings you see... Thanks.

Terms of Service / Acceptable Use Policy
All services provided by <<company>> may be used for lawful purposes only. The transmission, storage, or presentation of any information, data, or material in violation of any law is prohibited. This includes, but is not limited to, copyrighted material, material we judge to be threatening or obscene or material protected by trade secret or other statute. The subscriber agrees to indemnify and hold harmless <<company>> from any claims resulting from the use of the service that damages the subscriber or any other party.
Any and all pornographic content and sex-related merchandising is prohibited on all <<company>> servers. This includes sites that may infer sexual content or links to adult content elsewhere.
Also prohibited are sites that promote any illegal activity or present content that may be damaging to <<company>> or any other server on the Internet. Links to such materials are also prohibited.
Examples of unacceptable content or links:
· Pirated software
· Hacker programs or archives
· Warez sites
Commercial Advertising - E-Mail
Spamming, or the sending of unsolicited e-mail from an <<company>> server, or using an e-mail address or domain that is maintained on an <<company>> server as reference is strictly prohibited.
IRC
IRC or IRC bots may not be operated on our servers.
Server Abuse
Any attempt to undermine or cause harm to a server or customer of <<company>> is strictly prohibited.
Refusal of Service
We reserve the right to refuse, terminate (cancel), or suspend service at our sole discretion. By uploading data to <<company>>'s servers, you give the said company the right to appropriate and modify the data as necessary from delinquent account holders.
Data security
<<company>> makes no claim as to the implementation of any backup solution at this time. If a subscriber feels their data to be important, it is their duty to make backups of it. In no way can <<company>> be held responsible for the loss of any such data.
Failure to follow any term of condition will be grounds for immediate account deactivation.
