I'm a newbie and just started a design and hosting business as a small side business. I have 3 prospective customers that I will hopefully be making websites for and hosting.
Are there any legal concerns in this business? Since I'll be a reseller, am I responsible.... let's say for emails that are lost if the hosting company has problems?
What are your experiences with legal questions? Thanks.

When dealing with Web Site Design clients, its best to have them review and sign your Terms of Service and Service Level Agreement before you start work on the project.

In your TOS and SLA, you basically make the client agree by that you are not liable for lost email, down-time, etc ...

If you don't, you are leaving yourself open for a frivilous law suit.

its a good idea ot use the TOS and AUP's of the company you are reselling from as a model - since you have to meet their rules also..

Would it be OK to modify a TOS agreement that I found and modify and adapt it as the TOS for my business?

Only if that TOS is from the site you will be reselling for.

Lets say you were reselling from my company - than you would be allowed to use and modify our TOS and AUP for your site - as you will allready have to be following them - this way all your clients would be not only following your TOS, but ours as well.

Its important that all accounts you setup as a reseller follow the TOS of the main hosting company you are a reseller for. If not, those accounts you created could face suspension / cancelation.
