Hello all,

I'm in need of a DMCA notice violation template for a friend who's band owns the copyright for the name. Some other kiddies from down in Oklahoma have decided they wish to violate the copyright purchasing the .net of the domain & as well as now using the same name for their band (Obviously.) My friend's band however is a little short on cash, and are unable to actually seek assistance from someone of the legal profession, which is why they came to me as I'm supposedly a little more in touch with the business/legal terms. Would anyone know of where I can find something that would allow me to basically send them a basic copyright violation and a DMCA violation?

Did you try googling for one? Many times I can find documents that way. I haven't tried for DMCA, as I haven't really had the need to.

If you private message me or email me through this forum, I can help try to help you with DMCA notices. Just give me a few days, as I do not have access to them for at least a few more days.

DMCA is somewhat complicated issue, but if you read the notices as I have a few times, you then have a better understanding.

In a way of quickly summarizing it, if the a valid DMCA notice is sent to the host/website owner, then DMCA issues are typically long and drawn out unless the infringer agrees to remove the material quickly.

Since when could names be copyrighted?

yeah i think that as far as bands go, unless they have a CD out, you'll be out of luck in trying to stop them...

A CD has been put out.

Either way the matter has been settled.

Actually, if it is the name of the band, it doesnt matter if the cd has been put out, but rather, if they are registed as a busines entity able to do business under that name.

If this other band in the different state registered their band name with their state, they can legally use the name in their state.

DMCA only applies to digital copyright violations, such as if this other band was using your friends band's lyrics as their own, or distributing your bands songs via mp3, and has nothing to do with entity name disputes, since a business entity name is trademarked/registered, not copyrighted.
