As of now I dont have any AUP or TOS which I kind of now realize is kind of a stupid thing to do. What I am wondering is if there is a place to get there or do companys just typically "borrow" one from another provider and change everything around. Any ideas?

I don't know of anyone that, if you ask nicely, wouldn't let you use theirs. I suppose they're out there. But I haven't met them yet.

Just find one you like; and ask.

If you are a reseller of another company, your best bet is to start there because you would want your TOS and AUP to match theirs in the term of content (not word for word), because you will be held accountable if your upstreams TOS / AUP are not followed.

If you are not a reseller, you probably have a dedicated or co-located servers somewhere, again start there and use the general content as a start. You can ask them if you can mirror it exact word for word and edit their name out and replace it with yours but I wouldn't advise that because you need to understand exactly what is meant by everything it contains. Just in case you have a situation where you need to clarify something specific or act upon a violation.
