Neo3Net 10-20-2004, 10:17 PM Ok, I was browsing the Tomsyer.net site when I came across their TOS/AUP. I read it for a bit, when I noticed it was very very familiar.

Same thing. Doesn't say much for TomSyer does it now.

Cirrostratus 10-20-2004, 10:22 PM EV1 happens to have a very strong AUP/TOS. I dont see any problems with using it.
I would be more worried if he had NO AUP/TOS listed like many other resellers.

I really doubt that. I'm sure they have other legal issues they'd rather dedicated resources to that don't include prosecuting those that plagarize their TOS. It's a fairly common practice, and I don't ever remember seeing anyone get bent out of shape over it.
Derrick 10-20-2004, 11:21 PM Depends, a smaller company may not persue it but I bet EV1 would. Usually just a nice little letter from their lawyer would take care of removing the copied TOS, wouldnt cost that much either.

they actualy allow you to use it without any trouble of any kind.

I thought I had read that somewhere, but couldn't find out where to link in this thread. Any ideas as to where it might be hiding?
I thought it was they allowed their customers to use it. Not just anyone.

kris1351 10-21-2004, 11:21 AM EV1 allows you to use parts of their TOS/AUP if you contact them. He may have had servers with them at some point.

There is nothing wrong with copying a TOS.

If I was a company that paid my lawyers money to write a Terms of Service, and someone just used it without permission or written consent. I'd be very pissed.

EV1 has stated their clients can use their TOS, but has also stated their competetors (eg: Tomsyer) can not.
I remember this explicity coming up in ev1's forums -- people kept posting "oh, they let anyone use it" and HS himself posted saying that offer was not extended to other dedicated server providers.

You can use their TOS as long as you are an ev1 customer.
