View Full Version : Is Managed.com Helping Out?

I wonder if Managed.com is actually going to be helping out AN customers so that we could get our data from there and do not have to worry day and night over the problem of our data being lost.

Far as I know right now, Managed.com is not going to help us out at all and would only speak with AN people (eg. Donna). I tried calling them (managed.com) up and asking them if I could just be send my customer's database so that he does not have to lose vital information. The reply I got from Managed.com is that I could not do that. The only thing that I could do is get Donna to resolve the issue with them.

On this point, I told them that I could not locate Donna and the AN people are running away and not caring about us people anymore. This all was to no avail...

If anyone knows of ways of getting help from Managed.com or etc, then could you please help by telling us what to do and etc?

Managed.com has NO obligation to anyone other than Donna, and that ended when the bills werent paid.

Get your backups and find another host. :)

Managed.com cannot determine who's server belongs to who. They are not allowed to give out data to anyone but the owner of the server. It would be illegal for them to help you, even if they wanted to.

Managed.com, or any other provider in a similar situation, is legally and professionally prohibited from allowing resellers (of AN) or end-customers to retrieve data off of their servers. Couple this with the now oft-mentioned fact that the 'data' serves as their sole means of recouping any costs, it would not be a wise decision for them to unilaterally enable access to servers. While not familiar with the full details of this, since I'm not an employee of either company, it is worth noting that there is a contract in place (be it verbal, written or implied through purchase of goods); and in any (US) contract, there are implied covenants of good faith, and UCC provisions which, if violated by either or both parties, would make any potential legal actions both more likely, and with much more far reaching and damaging consequences.

The best bet in this situation, which isn't always attainable, is to reach some mutual agreement with both AN and MDC for a formal legal release of content and/or property to the Customers, if in fact AN is not able to fulfill debts for the property and/or services provided by MDC.

Yes you are right to say that. But could they not be so nice as to tell everyone on the server that they will be putting it on for an hour or two to help us out by allowing us to backup our data? Right now, they are not even going to do anything at all. Not even getting the server up so that the users of the server could get a backup of their files.

If it was for me, I would have given people a nice hour or 2 of uptime so that they could backup their data and do whatever they want to move to another server or something like that. The could eventually turn out to be Heroes instead of being a Bum right now...

Get real! This is your dedicated server providers problem, not managed.com.

This is not their problem... take it up with your host, if you can.

If I could even have a chat with AN, I would have done so already. Unfortunately, I could not even get a hold of anyone either online or offline. It just makes nothing easy on my side.

Ps. I also did tell Managed.com that I would be even willing to buy a server from them if they would be nice enough to just let me use the server for a few moments to backup my data. But I guess that too is not possible.

Please I have heard enough about this and people blaming managed. Get a reality check you are not there client get over with what is right and move on. Businesses are not here to make up for other businesses mistakes. You took the cheap risk and now you're paying it is over quit blaming managed. Live and learn and hopefully next time you make the right decsion to spend extra and have security with your host. It cost managed more money to put the servers back and all kinds of liability issues open up. It is not there responsibility to help any ANz clients out that is ANz which it seems they have flown the coupe. Please move on for the sake of yourself and any clients you have ANz is most likely done and gone just live and learn from this. Next time pay managed instead of a reseller and you will have a reason to complain to them. I am sorry I just feel everyone in this situation needs to move on and quit blaming managed for ANz fault. They deserve nothing to be said bad about them as it was never there fault. Again I apologize if I was rude I am just trying to state the facts.

Just a small not from me to you, Nuke...

I was even good enough to offer Manage.com that I would pay for this month's bill and get everything back instead of nothing at all. If you think that it's wrong, then can you tell me what's right?

Is paying for a server without the root access and etc gonna cause liability issues? Are there any other problems with it? Would it be wrong for me to pay on behalf of AN?

Noone is blaming managed... But if they put the servers online for a brief moment after they really can't get a deal witk AN, it would be so good for the customers and they wouldn't break the contract with An. If that would be true they would have broken it it the past months when an wasn't paying.....

Everyone with the right password etc could get their data...... They don't have to give access to anybody, just the ones with the passwords, like normally....

I could reach my zerver the last month, and an didn't pay then....so whats the difference.... An will get whats coming to them..... But now a lot more people get it.... And i'm not one of the people that are that much hurt. I made backups. But i can understand people would like managed to do that.

And whats really wrong with it? Nobody really bashes managed for this. Most customers on the an-forum stated that when some were blaming managed....

Its just a suggestion that would help a lot of people..... Nothing more, nothing less. It's up to managed if they want to do that....

And if they don't... AN is to blame.....

********! I mean they could turn the switch on there own servers for 10min... and say opps.. that aint ILEGAL were not asking for root passwords.. As I see it there just bunch ******** who just hurt there hosting company so bad..

In your main questions it does not matter what is right for them to do. They simply because of liability and privacy issue cannot give you the server even if you pay for it 3 folds. So rather it is non root whichever it cannot and I am 99% sure it will not be done. As if it got out they did that I am sure ANz would sue them rather they care about it or not. It is never right no matter the circumstances to give you access when you are ANz client not there's. I am sorry if you feel this is not right it simply cannot be done in today's business world. If they did it for ANz they would have to do it for every hosting company that goes down the drain for the clients. Simply put this not a fiscally sound policy because they will be charged for it from there own providers. Eventually they will do it for one company that goes down the tube and get sued and have to pay them or lose there own business. So again I am sorry if I was rude but unfortunately in today's world you just cannot open your business up to being sued.

Now I've never had my own dedicated server, only a reseller hosting package and admittedly most of the sites I host are fairly simple and small.

Is it that people have no backups at all or that they are trying to get a more recent backup, perhaps the last one they have is a month old?

Did AN backup the servers they sold? If AN did not backup the servers, who was the backup down to, the end user or the reseller?

Not trying to pour more salt on the wounds here, but where are the backups?

No everything is our own fault...... i have only one clients backup that was corrupted or something....

If they would be liable (is that the word?) to put the servers online now, then they are liable for the months an didn't pay. They stated that there were billings from earlier months. So they had the servers online when they were liable before....didn't they? At least in your explanation.

I can't see why they would be liable when they just put the servers online.... they did it last month.... an didn't pay for that time....

Ok, its their decision, but it would be nice for a lot of people if they did....

All this is really not their fault, but they could be human and do it for a momnet and get a lot of goodwill....

Isn't surprising considering a lot of AN clients must be asking them the same thing :)
