Now before I start I just want you to know that this is not having a did at anyone and I only come here in search of answers.

I listed some assets of my web hosting business on WHT:

http://www.webhostingtalk.com/showthread.php?s=&threadid=286662

I listed along with other licenses and software my Boxed art License. Boxed art then replied saying I cannot sell this license! Fair enough so I told them I wasn’t going to.

Now what annoys me is that hey have now frozen my license and I cant access boxedart.com so they have effectively stolen my $50 and will not give me any form of access.

Now the only reason I can think of why they did this was because I said i was going to sell my license, but when I indicated I was not going to they still did not freeze the license.

Regardless of what anyone says this is illegal and they cannot do this. There TOS say I cant sell a license, no where does it say I cant talk about it!

Someone please help or advise me what to do next.

Thanks

Stuart

P.S This is a last resort as boxedart have not once replied to me, they didn’t even tell me I was suspended.

Couldn't find a contact phone number on their site anywhere. Is there a BoxedArt representative on WHT?

Any help would be greatly apreciated.

Thanks so much

Did you try contacting them through the email address with domains by proxy, that actually gets forwarded to them, and if you complain to domains by proxy they will probably even be able to get you proper contact info, etc. You may also want to mention a chargeback (not necessarily do it), this will help you get a response. :)

Your best bet is to get ahold of Jason M. DesRoches, the owner of Big Resources/BoxedArt. Since Big Resources,Inc. is an actual corporation you should be able to find some contact information somewhere (since it needs to be made available somewhere).

The company was originally incorporated in PA if that helps.

I recommend heading over to www.htmlforums.com and post in one of the forums. I believe he regulary monitors the forums (he is an admin).

Yes that is quite ridiculous, I wouldn't let them get away with that.

There are no tickets or email support requests submitted by this user. This users claim that his tickets have been ignored through BoxedArt's ticket system are blatantly untrue. BoxedArt does not ignore support requests or tickets submitted. This account is noted as being turned off for terms of service violations. Webhostingtalk is not our support forum, so if you require support, I suggest submitting an actual ticket to BoxedArt.com, which you have not done. BoxedArt has acted consistently with its terms of use in the deactivation of this account.

I really can't say i disagree with Boxed Art here. You tried to sell the license so they disabled your account. Break the rules, suffer the consequences.

Blackdog has a good point here, you did break their TOS, but I think they should have notified you first before disabling your account.

Thier templates arent the best ... and many people have them.

If I were boxed art I would be annoyed at the fact that you wanted to sell your account .... I actually read their TOS before signing up about 2 yrs ago..

I think BoxedArt should turn the account back on.

He make the mistake in thinking he could sell the account, he was informed he couldnt and then decided to keep it. That should have been the end of it. If BA was concerned he was still selling it privately, They should have monitored his IP's for a change.

After reading these threads, I agree that this is unfair on BA's end.

T-Com has continued to show dishonesty in addition to his attempt to break BoxedArt's TOS. I have checked through BoxedArt's ticket system once again, and his only ticket submitted was one prior to his initial activation, which asked when he would be activated. He has submitted no other tickets, despite his claim of submitting 9 tickets, even after the drama of this thread T-Com has yet to submit a ticket to BoxedArt. If T-Com still claims that he has submitted 9 tickets to BoxedArt, please post the ticket numbers so I may look them up. He has, however, since sent PMs to me via this message board, which I stated before is NOT BoxedArt's support forum, with statements just shy of blackmail in a demand to activate his account.

Despite having all of the above, BoxedArt is completely within its licensing terms of service to shut down a users account that has attempted to breach its policies. It would be a disservice to both our company, as well as our terms of service abiding members, to allow somebody that has already demonstrated their ill-intent. This is furthered when a user adds dishonesty to his complaint.

I have to agree with boxedart yet again. This is not the place to dispute their services, boxedart has always delivered great service to me and i see every reason why your account has been terminated.

I would suggest instead of trolling boxedart at every oppurtunity you actually submit a ticket and sort it out with them or heres an idea....read their tos first.

can you provide trouble tickets numbers like boxedart asked? Just to be 100% fair on my judgement.

Im sorry...based on the way you are dealing with the situation T-Com i would believe boxedart over you. Deal with the issue with boxedart and not on a public forum like wht.

You got caught red handed attempting to break their TOS, they took action...you got angry and have attempted to ruin their name. Now deal with it.

Nope sorry your very wrong banners to go! I never sold my license, they told me not to so i didnt! Cants ay fairer than that!

They suspended it without contacting me and i tried contacting them many times!

Where else do i go?

He was notified that he was not allowed to sell his account and immediately afterwards he stated that if he was not allowed, he would not..... that should have been the end of the issue. Even though he did somewhat break the contractual agreement, it was a minor issue and in fact he did not legally break it. He never actually sold his account. Someone can say they have something for sale all they want, but until the transaction occurs, it's not a sale. In addition, the terms of his sale was that he was selling his assets and that he would "include" for free his account. Therefore it is a transfer of account without the means of transfer having been a sale. Now if the tos states that there is no transfer of account... period... then it's still somewhat of a breach of contract, however again it's a minor offense that did not warrant the action taken by boxedart. While it was within there legal power to do what they did to PREVENT the sale of an account, there is something called customer service and boxed art has not displayed this at all. A warning should have been issued first. In addition, claiming that a client is a liar isn't exactly a good practice either. Ever heard of "The customer is always right?"

Bottom line, I am actually in the market for the several templates right now and from seeing this thread boxedart has lost a potential customer. Sorry boxedart, you could stand to learn a bit about how to treat customers.
