So my partner and I formed sweb hosting company as a texas llc with the legal name "BLAHBLAH.NET, LLC" The state of texas accepted the name as valid and all and wow we were on our way!

Well I went to file for our EIN(Employer identification number) today with the irs and the application was rejected because the legal name of the company CANNOT have a "." in it. Apparently the irs's system won''t accept the . for some reason. I even called to file over the phone and the guy tried it and the system came back with an error.

What do I do?

Try it without a period -- BLAHBLAHNET LLC.

IIRC, the IRS system doesn't accept commas either.

Does it matter at tax time?

I thought that you had to enter your legal name on the tax forms exactly as it is on the articles of incorporation

Ask your tax accountant. That's what (s)he's there for and why its so very important you have one.

Actually I already do have a tax accountant and a very good lawyer. Just getting other people's opinions because this probably has happened elsewhere in our business. There aren't many tax accountants and lawyers that have dealt with internet companies.

If you have a tax accountant and a lawyer that doesn't know what they are doing, in relation to your business...get rid of them, fast.

I've never heard of the IRS not accepting periods or commas.... but before you submit "BLAHBLAHNET LLC"... you are correct, the company name must appear EXACTLY as you file it, in every way you present your company. Now, granted this is a bit of a technicality and im sure you can get away filing your name as BLAHBLAHNET LLC and presenting it in any ads, logo, etc as BLAHBLAH.NET LLC, but in a legal viewpoint, your company name must always be presented as you filed it

That's crazy. The firm we hired does our taxes and payroll for about $1000 a month. We do pay slightly more come annual tax time, but there's no way they charge us anywhere near what you've quoted.
