I read your AUP and loved this line "for bandwidth is $3 per 500 MBytes" on the overage part.

Slightly high but it would cover pleanty of cost.

the only problem with your AUP is the spam policy, way to narrow in focus. I would look to add a Double Opt-in rule for people maintaining a mailing list.

Just my 2 cents

Yeah, our bandwidth is much cheaper if you buy it in a package deal. Most people just opt to upgrade to a bigger account.

Our policy says "Unsolicited is defined, by White Lake Web/Affordable Host as: E-mail sent to recipients who have not asked to be contacted by you... "

That means that mailing lists are fine, as long as the recipient actually asked to be added.

Copying a AUP/TOS?!? :confused: :eek2:

You people do realize these are legally binding contracts, right? You shouldn't go around "copying" or "borrowing" someone else's service agreements. You should talk with a lawyer and get an agreement drafted for your own company.

Just my honest opinion...

Is there any lawyer out there that can actually lay down all these TOS / AUP / SLA for a web hosting company?

I am going to write these stuff too, and I am asking your permission here if I can copy some parts of your TOS / AUP / SLA to be incorporated into mine? Promise it won't be an exact copy... perhaps some points or sentence...

Any objection?

If you mind, then I have no choice but to retreat and meditate and try to bring my inner mental power to come up with these stuff but that might take 12 years to achieve :D By then, web hosting industry will be totally different, all my servers will rot in some junk yard ready for demolition

Terms of services (TOS) are the rules and regulation that bind the users to the service provider. "borrowing & copying" the TOS's out there will help you prepare your TOS and give information to your lawyer. Now if you just go out there and copy some terms, You are opening yourself up to a can of worms.

Go to about 10 different web hosting companies, copy thier TOS's, take the copies and spend 300 on a good lawyer. Cover Your Ass.

I am trying to keep my start up cost as low as possible, so I am not going to seek a lawyer at first. I want to see how things work out before I go and spend a lot of money on a lawyer. I am doing business as Sole Proprietorship. If my web hosting company takes off ( As I am hoping it will ) :-D then I will look into becoming incorporated and then seek a lawyer for professional services...

Not to get off track of this thread but...From what I've read and researched copy right is Ok if you get permission (written)...

"As a general rule, any original work -- whether text, visual art, photos or music -- is protected by copyright law, which means that you may not reproduce it without permission from the copyright owner. It doesn't matter if you indicate who the copyright owner is; you're not allowed to reprint (or distribute, adapt, perform or sell) the work without the owner's authorization"
