View Full Version : Unsolicited Fax Advertising

Has anyone else been receiving unsolicited fax advertisements for .biz and .info registrations, coming from a large, well-known hosting company? These are TCPA violations and I'm looking for enough common ground to consider a class-action for damages of $500 per fax.

If you have been getting them, please save them, and let me know.

how are you going to sue for $500 per fax? I mean a sheet of paper does not cost more then 10 cents. so you know what email me your address and I'll write you a check for 25 cents that should cover your lost...

(I was not me or my company that did this)

You aren't one of those people who says "just hit D" when you get Spam, right?

There is a well-known lax against junk faxing. It's the Telephone Consumer Protection Act of 1991. It's been used successfully many, many times against unsolicited fax senders.

If you get one I think thats ok. I dont think you should go and sue for that. Now if they are sending you 4+ then you go and do something.

So if they sent just one to everybody, it would be OK? What if a thousand business sent one to everybody, or even just one to you? This is really just a rehash of Spam arguments.

More to the point for Web hosting, though, how about the fact that they are advertising in competition with you, and are quite likely sending the same fax to your customers, and it's against the law? Why let someone get away with that?

I'm merely curious if others have been getting these. 9NetAve was faced with a suit over this, and after Concentric acquired them, it was a point of contention (Concentric said it wasn't their fault what 9NetAve did before they were acquired).

one_web, what they're doing is illegal. Are you saying that it's okay for them to do it just once?

It may not cost $500 for someone to receive a fax, but I think it's a fair fine for breaking the law. Of course my one speeding ticket was only $120. I got off lucky.

Well it may be wrong but at least fax spam is not as bad as email and mail. You only get a fax once in a while I get one about once a month so I really dont care. I read it then to the trash it goes. Maybe if its something that you get everyday like email spam and it starts to get out of control then there is a problem but one in a while...come on...

As I said before then that will be a problem. I think its fine that someone is trying to stop it before it gets out of hand...but dont over due it. Unless that fax broke your machine... $500 come on... per fax...

I haven't gotten any of that fax spam. Just these "X out yes or no and fax back" ones along with cellphone ones. In small letters at the bottom ($2.99 per call). Also cellphone ones. Both the cellphone ones and the stupid voting ones have the same number to call to cancel. If we get another one I'm calling it from somewhere I don't have to answer it at. I have a feeling it's either disconnected or setup to gather phone numbers from incoming calls. :|

And it hasn't occurred to you that the reason you only get one junk fax a month is because it was made illegal ten years ago and enforced very effectively through the $500 penalty?

You're thinking that the cart leads the horse.
