View Full Version : How can I bring this one to court?

I never tried this one, basically I'm not American, only been here for 5 years so I don't understand much about law, even English.

My car got tow in my apartment parking lot by authorized manager's calling (that's what the towing mail send to me) on Oct 15. I park my other car in the other side so when knew it got towed, it was Oct. 23rd. I went to the manager office, the mgr's assistance told me that he hasn't towed any car lately. I went home and got a phone call later from main manager saying that she didn't tow any car in the past 2 weeks.

To make it short, I got a mail today ask for $160 for towing and parking fee, because the car was parked in legal parking space, only manager has the right to call towing company, which my manager told me on the phone Oct 23rd that she hasn't called anybody to tow, I even told her my car's model and stuff when I was at the office. (Actually I did tow 2, once was nissan and other was ford, mine was honda).

It's really pissing me off, I want to make a small claim to the court about this (paying $160), but don't know where I can start, I felt the discriminstion from those people in the office. What number should I call? how the proccess works, it's not a much of money, iI just really upset about the way they treat me, please help me, thanks in advance.

The name is MAC Towing, but I'm not bringing towing company, I was talking about manager because they called them.

Did you get your cars back?

You should go in and talk to the towing company and ask them why they tow cars away when it seems as just anybody can pick up the phone and request a car that doesn't belong to the caller or towing company to be moved when cars aren't illegally parked.

You should give the invoice back to the towing company and tell them to claim the money from the caller.

If the management did not call for it to be towed and if you had parked in the legal space the I suggest that you first report this to the police. Then you tell the towing company to return the car and tell them that you will take them to court as they can not just come and tow away a car parked in a legal space (your manager should be able to back you up on this).

If you need the car immediately (which I assume you do) then you should just pay the towing company first and go to small claims court to claim the money back. There are a lot of towing companies doing this on a regular basis to milk money out of people.

You can go to http://www.troubleshooter.com and ask them what you can do about this. Troubleshooter aka. Tom Martino hosts a consumer radio talk show and I am sure if you report this properly from their website the he might be able to help you and get you talking on the radio.
