View Full Version : Talk about blatant...

Hi All,

I thought I might post a little note about this... just in case anyone was considering signing up with this company.

Have a look at this site:
http://www.hayescom.com/

And then have a look at ours:
http://www.site5.com/

I have never seen such an obvious case copyright infringement in my life. They didn't even bother to remove the "Site5" from the sidebar on the front page. 90% of their content is copied verbatim.

Rest assured that this "company" will be hearing from our lawyer if this isn't removed shortly.

Regards,
Matt Lightner

Yeah, really "nice". They even copied major parts of their offerings including text.
Copy-don't-think.

I'm surprised they didn't register the domain site6.com so they would have less to change.......

Notice the graphic on the left? It still says "Site5". :D :D :D

Or setup sitefive.com or site-5.com*

Say...are they resellers of yours? That could explain it.

*runs off to register site-5.com

Nope... not even a reseller. Someone asked our sales dept today if we were the same company or if it was some kind of scam.

I haven't heard anything about them on WHT either... so they must be pretty small.

they are using even the same image names..
C'mon, at least change them..

Check this http://www.hayescom.net

that's why the order page is down, it's suppose to be .com

It's the same company/guy "Olliver Price" , have the .net and moving to .com

I emailed them asking if site5 copied them, heh... be sure to save site and screen capture. Really about as sad as it gets (love the site5 name going up the side, really swift). Their other site is horrid however, and they claim to design web sites (yeeeek), I wonder how many they've 'designed' before? Might want to shoot an email to the BBB.

LOL, they didn't even do a good job of copying....
the .net address, those buttons on the left were made by a flash generator at guistuff.com lol.

The .net says copyright 1995-2001 yet the site wasnt registered till 1998

the .com was 96

Just checked it again and it's still there..

Hi Joana,

We have been trying to contact them to no avail. We are still working on the issue, however. We will be sending notice to their mailing address today, so we shall see. :)

This thing I never understand ... why give them a chance to take down the stolen site? It's like telling a robber that has been just caught stealing something "hey, if you don't return that, I will have police arrest you" ... Matt, just contact your lawyer and sue them badly! why wait? :(

cheers,

Matt Lightner
10-30-2001, 03:11 PM
Well, we're not really in this to sue anyone. All we want is for the site to be taken down. Getting into a huge legal skirmish is time-consuming, and chances are that they will take it down upon our request.

If for some reason, they refuse to comply with our requests, then we will seek legal action.

does anyone know where to find a letter to send to someone that has stolen your copyrighted material? because i am spending a lot of money on my site and if i ever see my site stolen i will not hesitate to mail them that letter.

ReflexHost_M
10-30-2001, 03:39 PM
Lol - obviously they are not doing to well in business with regard to hosting - they have one of those banner-exchange banners at the bottom of the site... hehe, I bet that makes more money with people clicking on it, than they do from hosting customers...

Let us know how the situation is resolved, Matt :)

I think they are masters in using Teleport Pro but there it ends.

I believe that everybody copies things and ideas in a way and I really don't mind people doing something with someone elses ideas to make it even better or ad something personal to it or twist it a couple degrees but this is a really sad case of a one-on-one copy.

It amazes me that there are still some people thinking they can get away with it but that is probably because some people do get away with it every day :-(

well I must say these pages
http://www.hayescom.net/services/hosting.asp
http://www.site5.com/services/shared/comparison.html

totally dif ;)

(joking of course)
man what are they thinking well guys lets trade sides of the little icons and we can do that little piece of text black (oh we wanted white but can't figure out how to do it well get out there and figure out how site5 did it !!!

the fact they tried to save your graphics after editing as jpg files shows that they are idiots
man hope all these copy people just get there fingers chopped off so they can't do this anymore !!!!
arghhhh

added
also as Chicken said love the site5 on the side
dohhhh

on another note if you want to go after someone with a lawyer involved dont try anything on your own if you let the company know you are coming they have time to build up a defense if you just come in and hit them they didn't know it was coming.

Well now, they did make the effor to flogup the images with the plans. Notice that the symbols don't match the hack job at the top, since they switched them on top of the columns. Is symbol for webpower a lightningbolt or a person?

Yeah, that's about as bad as it gets :(

Just another sign of the types of horrible companies selling hosting services. No wonder the industry carries a bad reputation in some peoples mind.

Well, it took me awhile, but I found a page that links to Site5

http://www.hayescom.net/services/servers.asp

In the private Label section there is a hyperlink on Shared Hosting Plans that goes to Site5.

You got to read all of that text in that section though, it is actually quite funny when you see that they substituded PC Anywhere 10.0 for Cpanel 3.4.

I understand getting ideas from sites, but to do a complete copy is unbelievable stupid.

I think that I am gong to start a hosting company and make every page in the site a copy from other sites. Each page will be from a different site. Some pages will reference RAQ's, other Linux, and I will even mix in Win2k and WinNT pages. I wonder how many people will sign up? It probably would make as much sense as "the famous Windows 2000 Advanced Server PC Anywhere 10.0 control panel", you know the one that has reseller capabilities.

Worst thing is they will probably say that they paid some web designer to do it for them. Not that I believe that, but a site the size of Site5 wouldn't be cheap!

For their defence, I should add that it I were to copy somebody's site I guess I'd chpose yours, 'cause it's a very good-looking site ;)

Matt, make sure you also shoot a letter off to Microsoft because they have MSCE logos on their home page and I'll bet you dollars to doughnuts they're not actually certified (considering that looking at their ".net" site leads one to believe they're probably just learning how to use a computer).

I have had this happen, as have many others.. but having just seen another one [yecchh!!] I just sent him an invoice for $1499.00, so I'll either get lucky [need the money] or he'll take it down, silly tit..

David, how can you say that's copied? Sheeeesh, some hosts here with their egos. The table headings are a slightly different color. *Obviously* they just happen to have completed the exact same catagories, and I'm sure that by the time you finish MAILING LISTS, MySQL & PHP, SHOPPING CARTS, and then start on the Running Your Site section, they will have worked hard and be done with their sections too. ;)
