View Full Version : Help: Company not releasing my paid for domain

Hi all,

About a month ago I made a post about I had a server with Version12.net and at the time of ordering the server, I purchased the domain name moose-shack.net (I own moose-shack.com, .co.uk and .org.uk) through them.

I got rid of the server after a month as it wasn't working out (was on the slow side and had problems, plus Ensim is eeeeeevil).

version12.net sold out to 5 Star Communications soon after.

Because there is some kinda rule that you cannot change IPS tags until 60 days after registration, I couldn't change the domain to my control.

I forgot about the domain until a month - 6 weeks ago, and looked up the whois for it.
All the details about me owning it are gone!
5 Star Communications is slapped all over it with no reference to me!

I emailed them about it and they want proof that I own it - which I have none. All the emails I got from version12 do not mention the domain name and I had no contract to authorise buying it.
The invoice I have is for the total of the server + domain included (which is listed as 1 payment and no mention of the domain).

I told them this and also told them to check the domain details of my other domains that I own - why would anyone want moose-shack.net other than me, as it ain't even successful!

No reply from them, so I resent it. Still no reply.
I have emailed them about 6 times and each time, no reply.

How best might I get a refund or get the domain back?

Is it right to chargeback the cost of the domain name?
(even though it won't be listed as $20 because it was included in the total server price).
Do I charge back the entire cost of the server?
Seek legal help (even tho the domain isn't worth anything to anyone other than me)?

Any advice is appreciated.

Checking out the whois, I'm assuming that you are not Priz*net? (listed as registrant).

You need some kind of documentation to prove that you paid these folks money to register the domain on your behalf.

My advice would be to assemble as much documentation as you have to show the transactions between you and the company and send it to the new owners.

If they refuse to play ball, you have two other options I think:

1. Approach Dotster (the registrar) with the same documentation. If you were very nice to them they may be able to prove that the domain was originally registered in your name (it should have been).

2. If you paid with a credit card, go to the card company and say that the goods you paid for have not been given to you.

You do need some kind of documentation to prove that you asked the company to register the domain for you though.

is not true. First, only *.uk domains have IPS Tags, not US domains like .net. Second, there's no reason why any details cannot be changed just as soon as the domain was registered. Changing registrant ("owner") can take time tho -- but the domain should have been registered in your name, definitely not in the ISP's name.

Hi,

The only documentation given to me was the bill for the server with domain name added onto the price, and email conversations between myself and Allen about how to set up nameservers of ns.moose-shack.net etc

I have no documentation saying "This domain belongs to you", only email conversations.

Have u tried emailing the guy that you were talking to that worked for the company? Maybe he can back up your claims.

I did try - his email address is no longer active because he no longer owns the company.

James, I looked through the forum and tried to search for some info for you...

I didn't come up with much, *but* Allan....

The admin panel says:
Last Visit 2001-09-16
Last Activity 2001-10-17

Which doesn't make sense to me (as I don't know how activity could happen *after* visit date, but...).

You can also whois the domain above and find two snail mail addresses (not sure if either are still conrrect?), but worth a shot.

Someone pointed this thread out to me. I apologize, I did not know why 5SC would not release your domain name.

Contact Ankur Chaterjee (ankur@5sc.net) and let him know that moose-shack.net is your domain, and you would like it transferred, and give him your current contact information. If he has any questions have him drop me an e-mail at allan@allan.org. I'll let him know that you did register the domain through us (although I believe he has that information in the customer list we sent over).

I'd make the change for you but, after selling the company, we no longer have access to the Dotster control panel.

This is unfortunate, and I hope you are able to get your domain back. However, this only serves to illustrate once again why one should NEVER, EVER let someone else handle their domain registration for them.

Hi ya all,

Well, I emailed that account on Sunday and requested a read receipt. I got the read receipt on Monday and as of yet I have heard nothing from them. I will give them until Monday to reply before going to my CC company and getting them to deal with it.

Just updating you now...

No reply back from that company after emailing them. I know they got the email as I got the read receipt back, so obviously they read it.

So now I am going to contact my bank and get them to chargeback the cost of the domain - you never know, they may just chargeback the full amount I paid (domain + server) - that'll show them not to ignore people.
