For almost an hour now. It's a good thing I decided to monitor their network before signing up. Third downtime -- 8 hours last weekend, 2 hours couple of days ago, and now down again...

Yes this downtime is KILLING my one server I have over there with them. No notice or anything of these latest downtimes.

EFS seems to be back up again. According to my monitoring software -- it lasted almost 4 hours. Anybody knows the official word on what happened this time? I hope they are not going to go bankrupt refunding all the money according to their 99.99% uptime guarantee.

You would think they would email us and tell us they were having a router put in (Last weekend) and today, they have no excuse for.

An explanation for today's outage will be forthcoming. For your information, we were answering phone calls throughout this afternoon from other customers about the outage. The contact number to call is 415-816-5644 or 650-627-8715. If you were calling 415-671-3841, that line is no longer in service.

well we will get a not out later after we can make up some excuse that will sound like we are getting better and doing great things for you ???

to many people called it so we just quit answering ??
well our phone line went down (which was also our main network line that is why all the outages ??)

actually my parents got tired of me using there phone and said I had to get my own one ??

well my cell phone got taken away from me so I had to get a real number which meant I had to rent a house to have it installed
dang no more living out of the NOC I said I had ;(

to me all lame excuses but some could be the truth ????

I would now say that they have cut there own throats and our going away for good or will be out of business

the question is is there parent company having the same problems ?????
anybody know this ???

a network friend of mine did some checking and said to stay clear of this company big time (this was a month or so ago) as he said they are not connected the way they say they are basically lying about it !!!!

That only means that the 20 month contract is not legal and you can get out of it without any probs.
How can it be legal if one party lies about facts?

I think we need to see a copy of the contract before calling it illegal. Companies can lie all they want to, but if both parties agree to specific terms, then the contract is legal -- assuming of course that both parties are of legal signing age and there are no illegal activities implied or construed.

well here is part of there contract
8. Uptime Guarantee: EFS Networks guarantees that our network will be available 99.99% of the time in a given month (no more than 5 minutes downtime per month), excluding scheduled maintenance. EFS Networks will refund the customer 5% of the monthly fee per additional 30 minutes downtime (up to 100% of customer's monthly fee). Network uptime includes functioning of all network infrastructure including routers, switches and cabling. Network downtime exists when a particular customer is unable to transmit and receive data and EFS Networks records such failure in the EFS Networks trouble ticket system. Network downtime is measured from the time the trouble ticket is opened by a customer to the time the server is once again able to transmit and receive data.
if I were on that network I would demand that they be paying me back
also there is a point if you entered into a contract on good faith of the said services and the other party is not capable of providing the services that were entered into that the contract can be nullified (spelling)
basically this is a case for a contract lawyer (I had contractual law as part of my college and remember soemstuff like this)

funny then they try to get out of the fact they know they can have the contract nullified here
If any provision of this agreement is held to be invalid by a court of competent jurisdiction, then the remaining provisions shall nevertheless remain in full force and effect. E.FreeServers and customer agree to renegotiate in good faith any term held invalid and to be bound by mutually agreed substitute provision.
yeah guys pull your head out you can not make some one go back and enforce a contract after a court ruling ???

and who are you going to get to inforce this ?????


then in there next clause if they do go to court try to prove that you are still liable ??
they wil try to make you go through arbitration relating to the above ????

efreeservers seems to be trying to pull one over on people ;(

does it list what will happen if they fail to meet there SLA? a credit or?
