Ok need to find out some thing here as i am a little lost here.

Let say you have Chickenhost.com as your domain. You have a real (burst) tm for Chickenhost.com

Now if some one goes out and buys Chicken-host.com and has a site close to yours ( Not in design but in what they do. Let just to say hosting as this is a hosting forum) is this a infringement on a Registered Trademark.


I just used Chickenhost.com & Chicken-host.com since i like the Chicken here so much :).. This is not a real hosting co. But may be a good name for Chicken.. By the way here is my tm on Chickenhost.com tm

It very well could be an infringement, if it is a very similar name, used for for the same thing, in the same area, depending on the type of trademark you own. One of the problems is that trademarks aren't automatically world-wide, although the web *is*. This has created new problems that really didn't exist before.

Just because you have a trademark for mac.com (as in Apple computers), doesn't mean that mac.net is a violation (this actually exists and is a real example of what I'm talking about). You wouldn't, however, be able to use mac.net as a brand name for the computers you build and sell.
