(will move the applicable posts here from the ad thread pending) zsindhu 12-17-2003, 02:33 AM Matt, I resent the topic ;) Please change it to "InsPanel" discussion :) tohi 12-17-2003, 12:25 PM zsindhu, What happens if it goes the other way and THEY suit for CopyRights? Those who bought the licence will be in deep #$@ especially if we already have clients using it on our servers. mashar3dh0st 12-17-2003, 12:56 PM WOW! my first few days on webhostingtalk.com and i find something intresting. zsindhu, as tohi said, if some one went out and spent money on your product and later on the Command Matrix people take up copyright issues in a court of law your clients would be in deep #$@. zsindhu 12-17-2003, 03:32 PM :) For someone to own a copyright to anything, they need to "own" that thing (in this case software) by way of legal purchase. Etrinix does not. The rights to the software were never signed over to them. :) mashar3dh0st 12-17-2003, 04:03 PM This is getting more intresting by the minute. I'll see how this post goes on. mashar3dh0st 12-17-2003, 04:29 PM I just did a whois on the inspanel.com domain and found that it was just registered in Sept 2003. Their site appears to be put up in a hurry, lets not forget its a complete rip of etrinix.com, the price of a $350 product is knocked down to $250. I think they are trying to make some quick sales. A classic "hit and run" operation? ***** B E W A R E ******* I personally would wait for two to three months for this to clear up before investing $250 on a ripped software. Etrinix 12-17-2003, 04:59 PM All Concerned! A lot is being talked about Etrinix and Command Matrix. We feel some inside-things and the exact scenario would serve as the answer to your what's and why's. Human resource is the sole element in an organization. When they defy things, matters really become complex. Our Ex-CEO, Mr. Rehman N. Sindhu was made responsible for the development of Command Matrix. His brother, Mr. Zahid N. Sindhu, had a setup in Karachi Pakistan. So our Ex-CEO outsourced major work to him. Later on, when Etrinix grew up as a good future prospect, with his brother and few of other employees, he tried to take over Etrinix (July 2003). Etrinix has proof to all what has been stated above. It is being wrongly told that Etrinix had some kind of revenue sharing agreements. We strongly condemn this allegation and would wish to see the proofs of this, which can never be provided as Etrinix has never had such an agreement with any person or party. It does not matter for us if somebody rips-off our Control Panel, calls herself 'Former Etrinix' or uses our hard work to beg pennies - the wrong way. Because we at Etrinix are concerned more about the future and we know that looking back at the past is not the norm of leaders - they only learn to visualize a better future from the incidents of past, while going through all thick and thin. We are here for everything good; good software, good customer relations, good future and good money and soon you will be able to see what good things we have for you and your business. We thank you all for your support and guidance. Inspedium / Inspanel shall be hearing from our lawyers soon. -- For further details on the issue: http://www.etrinix.com/forums/showthread.php?s=&threadid=417 http://www.etrinix.com/forums/showthread.php?s=&threadid=320 -- zsindhu 12-18-2003, 03:52 AM Hello "Etrinix", You state that: 1. Your current "President" who is a "UK Citizen" appointed Rehman Sindhu CEO who further "outsourced" his work to myself in Pakistan. 2. "It does not matter for us if somebody rips-off our Control Panel, calls herself 'Former Etrinix' or uses our hard work to beg pennies - the wrong way." My Questions: 1. Do you have ANY proof of employment (an employment agreement etc.) with Mr. Rehman Sindhu? 2. Where was Mr. Rehman Sindhu (which country) when he was appointed CEO and "outsourced" his work to Pakistan. 3. What is the country of residence of this "UK Citizen"? 4. Which courts do you intend to pursue this matter in? 5. Do you have a copyright for this software? IF (big IF) yes, which country was it filed in? 6. IF the work was outsourced, a. What was the remuneration package you agreed to? b. How and when were the people you outsourced the work to, paid? d. Do you have an outsourcing agreement? c. Do you have proof of payment? 7. WHY does it not matter if someone tries to "rip" your software? It sure matters to us if someone decides to have someone else do all the hard work and not pay them. 8. Where are your "Physical" offices located at? Surely a company of this size and stature has a physical office (as opposed to the virtual office address state on your website) Please note that a transcript of all your answers shall definitely be archived and used by our lawyers :) Oh and, could you please state the number of employees Etrinix currently has, their names, designations and countries of residence? Just so that the clients of Etrinix have a better understanding of who they're dealing with :) P.S. We would HATE to be called "Former Etrinix" :) zsindhu 12-18-2003, 04:01 AM Originally posted by mashar3dh0st I just did a whois on the inspanel.com domain and found that it was just registered in Sept 2003. and.... did you do a whois lookup on inspedium.com ? :) Their site appears to be put up in a hurry, lets not forget its a complete rip of etrinix.com It's not perfect, I agree, but a complete rip? COME ON! :) BTW, can I have the adress to your website, just want to give my webdevelopers some pointers on how to design the perfect website :) the price of a $350 product is knocked down to $250. I think they are trying to make some quick sales. A classic "hit and run" operation? The InsPanel is priced at $499. We have a special going on to celebrate the launch. It's 50% off uptil January 15th 2003. I personally would wait for two to three months for this to clear up before investing $250 on a ripped software. You are free to wait as long as you want, but if you signup after January 15th, you'll need to pay $499 ;) sprintserve 12-18-2003, 05:48 AM Please keep the language civil and respond factually. I understand emotions may be running high for some, but we will be watching the thread closely to make sure it stays civil. Thank you. Etrinix 12-18-2003, 07:53 AM Etrinix does not consider answering the questions put up here by Mr. Zahid N. Sindhu to his satisfaction as all these will be answered once we are in the court of law. But we feel the responsibilty to answer the Etrinix Clients and public so that they may be clear about the things. We have the proofs of the employments of everyone. Our president is in Pakistan at the moment supervising the Development of our next version of Command Matrix and is a resident of UK. (Ref to : http://www.etrinix.com/forums/showthread.php?s=&threadid=417). Etrinix is not a mere Sep 2003 registered firm. It is a registered corporation of USA since long. We wish we could make our agreements and contracts public but it is against the business ethics. Everything shall be clear to the concerned when in court. We think; to someone who has sense, an effort to take over company's financial assests, a try of moving their official domain etc are enough to prove the criminality. We are focusing more on our present and future. It does not make sense to attend (100%) to lame things said or done by someone when there are more important things. (Everyone has a different priority). Etrinix has its employees in USA, UK and Pakistan. Though our past experience was not very good but our current organization is a pool of professional, committed and loyal staff members. A rip is a rip. Like every other walk-of-life, good and evil both exist in this industry too. What we need is a vision to differentiate. Techark 12-18-2003, 08:25 AM Well the shame of the situation is that this looks like a good CP but until this thing gets settled in court neither company can be too stable in their offering. This fight will damage you both as no one wants to move clients later if somone loses in court. WIsh you guys could get this settled but the way courts go it may be a year or two before that happens and with legal cloud hanging over your heads I hope you both have deep enough pockets to last the loss of sales. zsindhu 12-18-2003, 08:45 AM I respect this decision, which is very sensible. These things shall be decided in the court of law. :) The people following this issue should, however, note that the current statement made by the user "Etrinix" are quite contradictory to their earlier statements. I shall not be wasting the time of the users of this forum with endless debates. :) sprintserve 12-18-2003, 08:49 AM I think we probably reach as far as we can go and if a legal battle is pending, we should just leave it at here.
