Gentry,

I am looking for a dedicated server right now, I browsed the forum for a long time before I speak up.

I found the following article in managed.com's service agreement.

VII. Termination

This Agreement may be terminated by Managed.com, without cause, by giving the other party three (3) days notice via e-mail or fax. In such event, the company will be required to pay to the other party an amount equal to the unused and prorated portion of service excluding any setup charges.


Is it normal for a business to have the right to terminate their public service by only give 3 days to the other parties ?
Can you be so lucky to find another provider and finish setup and data backup/restore in only 3 days ?

Or Is there any sound reason for me that I can just ignore this article in the service agreement ? anyway their price is great.

Good luck finding a host that lets clients decide when their service can be terminated. ;)

They get bashed here all of the time, but I (and many others) haven't had any problems with them.

2) Read it again

3) Once you are sure you understand it all - Read it again

4) Now search these forums the search button is your greatest friend here.

5) "anyway their price is great." Now ask yourself why it is

6) If you are still convinced you are OK part with your money

One final point in any contract negotiation, you cannot ignore anything!!!

I don't know if it's standard in most service agreements, but it doesn't strike me as very surprising or that big of a deal, no.

That's a fair agreement. You will ahve 3 days to cleanup and move. It takes usually a day to setup a new server. They should pay you instantly with termination, they cannot terminate you unless you do something wrong and it's kind of hard with managed.com, but it would be nice for a warning first =/

It might only take a day to set up a new server, but you also have to change the nameserver information or register new ones (propagation alone could take 3 days), you have to inform users, etc.

I'd say a minimum of 7 days would be more reasonable, but that beeing said, it's in their terms and you know what you are signing up too, so the choice is yours to make.
