Hello

I am sure that most people here are aware of Totalnic's behaviour regarding transfer of domains and the way they act in order to prevent somebody from taking the domains out of them.

There are plenty of stories here and in other places. I am one of the victims as well. My 'mail' to them has been lost twice. Anyway.

The reason of this post is that I can't believe that people in ICANN have not heard of Totalnic at all. I am sure they should be receiving lots of complaints (I did it at 3 times) about this company. My question is why ICANN doesn't do anything at all. I really can't believe that they don't know anything. But why?

also this is from ICANN agreement i believe:

Registrars would be prohibited from using "Registrar Lock" in order to secure payment from registrants (TTF §2.20).

Losing registrars would be limited to only seven possible reasons for denying a transfer request – fraud, UDRP action, court order, identity dispute, non-payment for current or previous registration term with domain on "Registrar Hold," express objection from the registrant or administrative contact, or failure of the gaining registrar to follow the minimum required transfer procedures (TTF §§ 3.5, 5.21).

Losing registrars would be prohibited from preventing transfers of names that are on "Registrar Lock" status (*Note: this provision would appear to require modification of the registry software and specifications since currently all transfer requests for domains on registrar lock result in an error.) (TTF §3.6.iii).



we need to make one big complain to icann to open all the locks from our domains!

I've never heard of totalnic but I 've heard about DROA.com and ICANN does not do anything about them.

The difference between DROA.com and TotalNIC, is that TotalNIC is an accredited registrar, DROA is a reseller for I believe Enom.

So, ICANN is in a position to take action against TotalNIC, but not DROA.

The problem with TotalNIC, is not that they are declining transfers. In fact, they never see any requests for transfers, as any names with them are locked. They aren't breaking the rule about using the lock to secure payment, as they aren't asking for any money (directly). Since the domains are locked, any transfer requests are failed at the registry, and no request for transfer is ever passed on to TotalNIC.

They are still breaking regulations, though. The first being that they don't allow a transfer off their system until 150 days past the registration of a domain name or renewal. ICANN regulations state that a transfer should be allowed on or after the 61st day of registration.

Also, they say that the Registrar Lock should be able to be removed (forgive me, I can never find my way back to the same spot on their site, so the wording here isn't exact) via a simple process. Their process is far from simple, and doesn't allow for any checks or balances, as you can't send them the mail via any service that requires they admit they actually received the mail, ie, no fedex, ups, or registered mail.

The point is that in the one or the other way, these people are achieving their goal. Nobody moves out from them and ICANN doesn't take action. And then you don't want to lose your valuable domain (which practically happens if you let it expire) and continue to pay them. What a pity! :mad:

And imagine that when Totalnic started business, they were offering the half of the price that was standard those days....
