What compensation is offered for SLA failure?

Our SLA works as follows:
The 99.9% garantee applies for the full year, we will refund 5% of the customers monthly bill upto a maximum of 100% of the customers monthly bill for every 10 minutes more downtime than the 0.1% per year for the month in which the downtime occured.
