View Full Version : My Sad and Outrageous Story witn *****
***** has demontrated that it is the worse kind of company to ever do bsuiness with.
For those who have been wondering what the Service with ***** is like, this is my sad story with them.
I have a dedicated server with *****. On July 29-30, the server began to have an issue with logins and displaying web pages. Then, on July 31, it completely shut down.
I have now been without server now for 11-12 days. I have called and called and emailed more than 20 people at *****, none has done anything. Not only is their service ultra rude (they hand up on you) and incompetent (no coordination, support people do not know anyting), but they also lie to their customers in a way that is very outrageous.
And I believe the culture that prevails in that company is one of arrogance. I believe the CEO and President know the terrible image of their company, but they do not care.
Basically, ***** is now charging me for a service they are not offering. Since the server has been down for 11-12 days, I cannot get anyone to give me my customer's files. So, they are basically kidnapping my files on their server, and at the same time they are not getting the server back online.
Because I want all those who do not know ***** to know the kind of treatment you get with their customer service and technical support, this is my story.
I will be posting below all the emails I have exchanged with those people. It's a pity I cannot get to put the words we exchanged into text.
As long as ***** will not put my server online and will continue to kidnap my customer's files, I will be posting here on a daily basis my exchanges (emails or others, with them).
I have been the most patient of all customers, but now it's 11-12 days of downtime on my server. I cannot take it anymore.
I am ready to sue them. If anyone knows a good lawyer out there in Texas who would like to take this case and make ***** compensate me with their blood, please let me know their name and reference.
My story begins below. Judge for yourselves.
Thanks.
I failed to send attachments below, so I am now referring every body to the TXT files on the Web.
Apparently, the file attachment is too big. Please go here to read the whole thing.
Thanks

drhonk 08-10-2001, 05:04 PM You know .. with a lot of bad stories about ***** .. we can make a book :) :) :)
qslack 08-10-2001, 05:06 PM Good luck...keep us updated.
I think there is already one class-action or normal lawsuit going on against *****, so you might want to find out more about that.
Gliebster 08-10-2001, 05:11 PM Damn, there's a new ***** horror story every day. I was considering them for awhile but when I found this forum, I crossed them off my list.
I think they need to make their employees a little happier.
drhonk 08-10-2001, 05:15 PM ***** basically forgot that their business profile is providing service. I guess they saw the money they producing and throw away the original idea of providing service.
davidb 08-10-2001, 05:29 PM If you plan to do anything, make sure you keep records of everything, ie emails sent, calls made, to who. Im not a lawyer, but just saying I tried email and calling a bunch of times, I dont think cuts it.
node9 08-10-2001, 05:35 PM I too know, what ***** service is like. I don't know if Bobo is really new to this forum or not, but, you should always do searches here, before picking a host. You can get a really good idea on what type of people you will be dealling with just by searching on this great site :D
***** is most definately the worst service ever. The second worst I think is CobaltRacks. But, atleast cobaltracks refunded us *L*
I once had an account with ***** too. In their agreenment, they said they will give me 1GB space, but only 300MB. I wrote a lot of emails to their tech support abd customer service departments, and no one cares. I finally canceled my account with them after the 30-days trial period. But they charged me a setup fee + first month usage, and didn't give me any refund!!!!!!!!!!
To make things more readable for everyone, I am basically attaching the files showing all my communications with the tech people at *****.
This will continue until they get me my customer's files or get the server back online. My patience has been too great.
Please take the time to read each of the attached files.
THey contain repeated texts, but if you keep reading, you will see several new texts all over the place as these span the course of 11 days of emails and calls.
If you wanna publish these texts or information related to these texts on your Web site, please let me know. It is important that you contact me for permission to publish. Thanks.
I will also be happy to give interviews to those who want it. Simply PM me with your phone, email or questions, I will respond.
Note: I could not get these files as several attachments with this forum. I mixed the whole thing up, so read (lots of it). Some messages are repeated.
Thanks all.
Apparently, the file attachment is too big. Please go here to read the whole thing.

Do note that I had to get a server somewhere else in the meant time (2 days ago). The wait was becoming too long. That's why you can see these documents.
Thanks.
Deb Suran 08-10-2001, 08:50 PM I recently did some research for another former ***** customer (I'm one too):
There is an online lawyer-finding service at:
http://martindale-hubbell.com/xp/Martindale/home.xml
My search there on lawyers in Ft Worth who specialize in Internet law turned up the following four lawyers:
Tamera H. Bennett
tbennett@deckerjones.com
http://www.deckerjones.com
Decker, Jones, McMackin, McClane, Hall & Bates, A Professional Corporation, 2000 Burnett Plaza, 801 Cherry Street, Fort Worth, Texas 76102-6899
Practice areas: Entertainment Law; Internet Law; Copyrights; Trademarks
Clark R. Cowley
crcowley@whitakerchalk.com

Whitaker, Chalk, Swindle & Sawyer, L.L.P., 3500 City Center Tower II, 301 Commerce Street, Fort Worth, Texas 76102
Practice areas: Corporate Law; Trademarks; Franchises and Franchising;
Business Law; Copyrights; Internet and Electronic Commerce; Electronic Payments
Cheryl D. Smith
cheryldsmith@email.com
http://www.lawyers.com/cheryldsmith
Cheryl D. Smith Law Offices of, 1200 Summit Avenue, Suite 427, Fort Worth, Texas 76102
Practice areas: Employment Law; Personal Injury; Trial Practice; Computer Law; Internet Law
C. Matthew Terrell
mterrell@canteyhanger.com
http://www.canteyhanger.com
Cantey & Hanger, L.L.P., 2100 Burnett Plaza, 801 Cherry Street, Fort Worth, Texas 76102-6899
Practice areas: Commercial Litigation; Internet Related Litigation; Appellate Law
The average fee for legal services in TX is ~$200/hr, and because you're not known to the lawyer you will almost certainly be charged a retainer, and $1,000-$2000 is not out of line with the average there, according to my attorney.
Good luck!! They need to be stopped!!!
Thanks, Deb.
Those numbers will certainly help. You cannot believe how mad I am right now. 11 days is enough to sink any business that relies on Internet presence. All my customers are at my neck because of this.
***** is even kidnapping my files. The worse stuff in life is to deal with a company whose management you cannot reach. They tell their support and receptionists to never pass calls on to the managers. So, in the end, you are left to turn around in circles from one incompetent technician to another.
So, in the end, I am left with no server, no way to get my files out of there, and no one to talk to.
I suppose I am just gonna have to cancel my account with them, and still sue them for everything. I am not cancelling yet because I need my files.
When I get a good lawyer from Texas (hopefully from your list), perhaps a good injuction from the lawyer will get them to get me my customer files that they are basically kidnapping. It is better to work with a lawyer that is on spot in Texas because things can be expedited better.
It is really outrageous, I tell you.
Thanks again.
CWDHost 08-11-2001, 03:13 PM Hello just wanted to add my 2 cents about *****.
I had a dedicated server with them up until a few days ago.
The worst service I have ever had. The thing that started
it for me was the fact that it was a UNIX server and they said
the downtime was because of the CODE Red Virus. Maybe
they should try telling that to those that don't know what
it is all about.
Another bad thing was I made a technical support call
into them a few times and after about 20 minutes of
no resolution and the tech still working on the server
I heard this:
Tech: "Sorry I have just been notified that I have been on this
tech call to long, and need to move on. Thank you for calling
***** technical support."
I asked him if they would send in a support ticket and he said
I could try back later if I could not get it fixed.
Web sites not showing up but I need to get it fixed. Hmmmmmm
don't understand.
Can you believe that the problem was not resolved and they
told the tech to get off the phone because he had been working
with this case to long?
How long is to long? No time as far as I am concerned if it is
a problem on your part then it needs to be handled whether
it takes 5 minutes or an hour. At least let me know that they
are going to be working on it.
But they 2 shut my server down right after I paid my invoice
using an online check. What they didn't know is that right
after my server was down I called my bank and cancelled the
check.
I have since moved on to BurstNET and the server runs great.
They are a little light on the phone technical support, but
they did get me setup in a speedy manner and have handled
my support requests quickly.
Anyways I could go on for a few pages at least of troubles
with *****, but to spare the readers here I will cut it short.
Thanks for letting me vent for a minute here.
Regards,
Ray
B-Broker 08-11-2001, 03:25 PM Don't even get me started on this "company"!
<<EDIT>>
Com'mon guy,
You should know ***** isn't the host you should look forward to. Thread after thread have being bought out regard ***** bad services. It is an endless ***** complaint on this board. ;)
node9 08-11-2001, 09:10 PM lol
Can anyone find a post/thread that says something good about *****? I need a laugh
JCranfill 08-12-2001, 01:09 PM I had a similar problem with them last week. I appearantly pissed off the tech tho, because an hour after I sent an email to every address there I could find, and cc'ed a copy back to him, I was sent an email saying my box had been takin offline for a 'billing' issue.
Kinda strange, since we had paid a year in advance, and checking their own records, their billing department said I still had a $400 credit with them. They finally turned it back on after 4 days.
I just purchased a new box from OLM.
WildWayz 08-12-2001, 03:17 PM I have reported ***** to the Better Business Bureau and on Monday I will contact my lawyer. I am
losing business and ***** will have to reimburse me every penny I have lost.
I believe in *****'s terms and conditions they have a clause saying they will not be held responsible for loss of profits etc.

why don't you forward these files to FBI or any other law enforcement agency in U.S. which can investigate and sue ***** if they are realy wrong.
meandean 08-13-2001, 05:34 PM so where do we sign up for the _NEW_ class action suit ?
I just moved two sites off (yay), and am moving another next week.
I have to ask: if you paid with a credit card (and you should have if you didn't) why don't you tell them you will dispute the charges unless they resolve this situation. You are paying for a service which they are not providing and are not being helpful in resolving (the I have to go now... I'm spending too long on the phone is the kicker... what else is that besides a refusal to help you?)
I had a similar problem before w/ an ISP and nothing happened until I threatened them with a chargeback. Suddenly, I got a refund and my account temporarily reactivated so I could download my files!
At the very least it is a pain for the ***** and is certainly easy for you to go about doing.
Owen
Just so you guys know.
I am still without a server. Nothing has moved yet from last time.
The ***** saga continues.

Tell me about it... ***** has scammed me out of approximately $20,000!
Believe me, lawsuits are only the beginning for this matter.
I'm so pissed at these people I've organized a widespread effort to get the FTC and Texas State Attorney General to investigate this company for numerous illegal activities.
(The link in my signature has all of that info)
These people need to be stopped before their scam becomes and epidemic on the Internet.

A few servers and inflated "bandwidth" charges. Some of it has been charged back already. Still battling the other charges...
