Agree. Actually, for this crime he might not go at all. One of the guys around the corner got 10 months (multiple charges all non-violent), but never did a day since the crime was not murder, rape, etc. Plus, this was his first offense. He did, I believe 45 days, and was released. Jails simply do not have the room to hold non-violent offenders. I followed his case since his family asked me to look over his charges and give recommendations, since I'm paralegal. I recommended they call an attorney....
It is sad to say that if this is his first time KIAHost might have been joking but the truth is really he MIGHT do 2 to 3 months for a first offense.

2Grumpy 07-22-2003, 11:02 AM Yep wouldn't be surprised tif he doesn't even spend any time in jail at all, an 18 month sentence, especially for a "non violent" crime, is often what's the word, commuted? which means usually means parole (or is that probation? my lack of criminal knowledge I don't consider to be a bad thing haha) and if they do something "bad" while on parole they'll go to the clink then.

You won't get nothing... I don't think those other jokers will ever see that 75, 000.00 of resti money.
Best thing about this whole deal is the government has SOMETHING on him now. At 25 I don't think he will be able to keep his nose clean, and maybe this will be a baby step to hard prison time.
Tropical Tundra 07-22-2003, 11:14 AM Especially since the amount defrauded was only $75,000 and he confessed. He’ll probably spend a couple months in a county jail instead of Federal Prison. The upside is that if this is only his first conviction it counts towards his tally. He will probably continue on his scams claiming more victims eventually after a few more convictions then they’ll throw the book at him but not this time. I bet he’s out quick if he does anytime at all due to the small amount stolen and if he is a first time offender.

Are you folks expressing a lack of faith your own justice system? Its true there are always more victims than purbs but in the end I think the justice system will take him down a notch or two. With a conviction, its going to get really hard for him to get a respectable job.

No I was talking about the actual doing time part. No way he does 18 months in prison. As in reagards to his life a convicted felon I'm sure it will be tougher but he can always just open up another web hosting company. :D

I once knew someone very similar. Always selling....always scamming. Certainly, we are all glad to see his illegal activities halted.
However, I don't feel any joy whatsoever in this turn of events. Rather, I feel sadness....sadness that a young man has chosen the wrong path time and again and destroyed his life. That a young man has made irreversable mistakes and probably will never change...most certainly, will never escape from his past actions.
With his sales skills and obvious charisma he had the world in his hands. He could have been successful in so many fields. However, the fact that it came so easy to him meant that he didn't have to do it legitimately. He was so good he could seel anyone on anything. He built a cult-like following of believers. Had he channeled his energies toward legal and legitimate activity, had he had the proper mentors and followed their advice, had he developed a sense of integrity and right versus wrong, he could have accomplished anything he set his mind to.
However, he chose what he saw as the easy way out. Don't you wonder where his parents were all this time? Don't you wonder why he chose time and again the path of dishonesty and deceit? I do. And, I feel saddened that a young life with so much potential has been wasted and has gone down the wrong path.
Unfortunately, we see this all too often here in WHT. We see it in those much younger than Shawn. We call the Kentucky parents of the young king of web scam and they don't care. We watch the underage brothers with so much talent use it in all the wrong ways. I wonder if Tim, Larron, and Brandon, as well as many others who frequent here, are watching what has become of Shawn. I suspect they remain convinced it can't happen to them. I see 13 year olds with such incredible knowledge and talent and only wish someone was guiding them, someone was teaching them, someone was steering them in the right direction.
We all make choices as to how to lead our lives. Why do we choose the way we do? Is it early guidance from our parents? Is it those we observe around us? I never feel superior because of the path I have chosen of honesty and integrity. Rather, I feel blessed that somehow I was led down this path as opposed to alternatives. I pray that somehow the Shawn's and others of the world and of our WHT community will see the light and turn their lives around. And, when I see one going to prison, I only feel sadness, regardless of how deserved their punishment is.

Umm, maybe it's just me, but if Cyberwings was a scam, then somewhere along the line he must have pocketed something or it would be a rather pointless scam. Was he really broke at the very end? Only Shawn knows that.
And the palm pilot thing, the poinyt there is, he never paid the company back until they found him out, so it didn't matter what price he was selling them at, he was making money.

Well I was giving him the benefit of the doubt that he was hoping to make the 75K back and payback the company he embezzeled and then keep the rest for himself but since he was selling them for less the per unit cost he couldn't do that. I'm aware that his intention was probably just to steal the palms and sell them at whatever so yes at $0 anything he made off them was pure profit.

I much prefer people of the ilk of Shawn to have to WORK. A nice job digging sewage ditches or reclaiming a swamp and all of his wages going to pay back the people he scammed
rusko 07-22-2003, 09:51 PM that is forced labor and should not be legal (dont know if it is). i am sure that if he had a reasonably long sentence, he would *beg* to work; as anything, including manual labor. it gets awfully boring in prison after a few years =]
to all of you: you do not know what prison is like. he may have done enough bad stuff to deserve punishment, however no human being deserves to lose his freedom and be placed in such conditions.

susannad 07-23-2003, 01:45 AM that is forced labor and should not be legal it's legal in Australia to the extent of prisoners in some jails (privately owned by an american company) working. They make chairs and filing cabinets which are sold in retail shops
But I meant Shawn should actually have to do some tiring physical work -- get his hands dirty and calloused -- at proper award wages of course -- and have his wages garnisheed (what is that word I'm looking for?) to repay what he has stolen

He's likely to be assigned to a minimum level federal facility. That means racquet ball only 3 days a week and just HBO, not the Showtime/Starz package.
