Love these touchy subjects so I am going to add my two cents worth.

(a) First cent - Get a lawyer to be safe and do not take the next cent as advice but one persons thoughts.

(b) Second Cent - Take Kleenix, that is the name of a company that makes tissues to blow our noses on, is that name the property of the company and protected by all the laws, yeppers. So why do we have No Name Kleenix, Billy Bob's Kleenix, etc. This is because Kleenix has become so reconized as an actual product type and not a product name that others can use the name, that just can not use the name by itself, ie. Billy Bob's Kleenix.
